The goal is to establish a contemporaneous record that demonstrates the corporation identified risks, took steps to mitigate them, and monitored performance over time. This record becomes critical if a regulator or plaintiff's counsel later challenges the corporation's governance practices.

Looking forward, corporations should prioritize three concrete steps: first, conduct a comprehensive inventory of AI systems currently in use, identifying which ones process sensitive data or make consequential decisions about individuals; second, establish a governance committee with clear authority to review and approve new AI deployments before they go live; and third, implement documentation protocols now that capture risk assessment, testing, and monitoring decisions contemporaneously, before regulatory or litigation pressure forces after-the-fact reconstruction of the corporation's reasoning.
