Average Personal Injury Settlement in New York: Is It Reliable?



No single average predicts a New York personal injury settlement; value depends on damages, fault, and coverage.

A useful valuation starts with provable losses and then accounts for legal defenses, procedural deadlines, and the sources from which a settlement or judgment could be collected.

1. Why Published Settlement Averages Are Misleading


Published settlement figures may rely on different sources and methodologies, and some do not disclose whether they include settlements, verdicts, or both. Without information about sample size, injury type, liability, and available coverage, the figure has limited predictive value for an individual claim.



Are Online Personal Injury Settlement Calculators Reliable?


Online settlement calculators cannot reliably account for disputed liability, comparative fault, medical evidence, insurance limits, or witness credibility. They may not reflect recent statutory changes or the procedural rules that apply to a particular New York claim. A number produced by a calculator has no legal significance and may create expectations that do not reflect the actual value of a claim.



2. What Types of Compensatory Damages Are Available in a New York Personal Injury Case?


New York law recognizes two principal categories of compensatory damages. Punitive damages may be available in limited circumstances involving egregious conduct but are not a standard component of most personal injury claims.



What Are Economic Damages?


Economic damages cover quantifiable financial losses caused by the injury, including past and future medical expenses, lost wages, loss of future earning capacity, and costs for in-home care or medical equipment. Economic damages may be established through medical records, bills, and employment documentation, and expert testimony where future losses require specialized analysis.



What Are Non-Economic Damages?


Non-economic damages compensate for physical pain and suffering, emotional distress, loss of enjoyment of life, and permanent disfigurement or disability.

New York generally does not impose a broad statutory cap on non-economic damages, although specific exceptions apply. Insurance Law §5104(d) imposes a $100,000 cap in certain motor vehicle cases involving specified conduct by an at-fault injured driver. An appellate court may also review an award that deviates materially from reasonable compensation under CPLR §5501(c).



3. What New York Legal Rules Affect Settlement Value?


Several New York-specific rules can significantly increase or reduce what a plaintiff actually recovers. The rules that apply depend on the type of claim, the defendant, and when the action was commenced.



How Does Comparative Fault Affect Recovery?


In many negligence cases, including premises liability and slip and fall claims, CPLR §1411(a) generally reduces damages according to the plaintiff's fault without automatically barring recovery. Different rules may apply to particular statutory claims, including certain construction accident claims.

In motor vehicle personal injury actions subject to Insurance Law Article 51, modified comparative negligence applies under CPLR §1411(b) as amended in 2026. A claimant's damages are reduced by their fault percentage, and recovery is barred when the claimant's fault exceeds the combined fault of the defendants.



What Is the Notice of Claim Deadline for Government Defendants?


Claims against public entities do not follow one universal deadline. Municipal tort claims subject to GML §§50-e and 50-i generally require a notice of claim within 90 days and commencement within one year and 90 days. Claims against the State or particular public authorities may follow different statutes and procedures.

Many negligence-based personal injury claims are subject to a three-year limitation period under CPLR §214(5). Medical malpractice, intentional tort, wrongful death, and public-entity claims may follow different deadlines. An injury involving a subway station, public sidewalk, or municipal vehicle may implicate a public entity and special notice requirements, depending on ownership, maintenance responsibility, and the defendant involved.



How Does the No-Fault System Affect Motor Vehicle Injury Claims?


New York's no-fault system provides up to $50,000 in basic economic loss after a covered motor vehicle accident. Recovery of pain and suffering from another covered person generally requires a serious injury under Insurance Law §5102(d).

For actions and proceedings commenced on or after May 26, 2026, §5102(d) defines serious injury to include death, dismemberment, significant disfigurement, fracture, loss of a fetus, permanent loss of use of a body organ, member, function, or system, permanent consequential limitation of use of a body organ or member, or significant limitation of use of a body function or system. Settlement negotiations do not follow a formula. The factors below commonly affect how a case is valued, and no single factor determines the outcome independently.

5. How Does the Settlement Process Work?


A personal injury case may settle before trial or proceed to verdict when the parties cannot agree on liability or damages. The timing and structure of resolution depend on the facts, the parties, and the applicable insurance terms.



What Role Do Insurers Play in Settlement?


A liability insurer may evaluate, negotiate, and fund a settlement within the applicable policy terms and limits. Settlement authority may also depend on policy language and whether the insured's consent is required.

An initial offer may not account for disputed liability, future treatment, or damages requiring additional documentation. Accepting payment and signing a release generally resolves the claims within its scope against the released parties, including claims based on injuries that later worsen. An insurance dispute may arise when the insurer challenges liability, injury severity, or coverage.



When Does a Personal Injury Case Go to Trial?


A case proceeds to trial when the parties cannot resolve liability or damages through negotiation or mediation. Before trial, the parties may exchange evidence, retain experts, and litigate motions that affect which claims and evidence the jury may consider. A timely and properly commenced lawsuit may preserve viable claims and permit discovery, but does not guarantee a favorable outcome.

Review before accepting a release can also prevent unresolved future losses from being unintentionally waived.
