1. What the Settlement Changes for Investors
The agreement announced on October 9, 2026, resolves the New York Attorney General’s civil action against Mashinsky. Its monetary terms concern his obligations to the government, rather than an approved payment amount for each Celsius customer.
Conditional Monetary Relief
The order imposes a $25 million obligation that can be satisfied through a specified $10 million payment to the Department of Justice. A separate $10 million obligation depends on compliance with detailed imprisonment conditions. The maximum $35 million figure therefore does not represent an investor fund already available for distribution.
The agreement establishes no individual compensation application. It also preserves nonparties’ rights without creating new private claims or determining whether an investor can recover additional money.
A settlement announcement and a distribution notice answer different questions. The announcement describes obligations imposed on the defendant. A distribution notice identifies eligible recipients, calculation methods, and any steps needed to receive payment. Investors should check for those instructions before treating the announced amount as additional compensation.
2. Government Relief and Bankruptcy Recovery
State enforcement, federal criminal forfeiture, and Celsius’s federal bankruptcy proceedings serve different purposes. Investors must identify which process governs a particular payment.
| Process | What determines investor recovery |
|---|---|
| State settlement | Any officially established investor payment process |
| Criminal forfeiture | Any separately authorized victim recovery process |
| Bankruptcy distributions | The confirmed plan, claim status, and distribution notices |
State settlement
- What determines investor recoveryAny officially established investor payment process
Criminal forfeiture
- What determines investor recoveryAny separately authorized victim recovery process
Bankruptcy distributions
- What determines investor recoveryThe confirmed plan, claim status, and distribution notices
The Chapter 11 plan remains central to creditor distributions. The state agreement does not itself amend that plan or increase an individual claim.
Official guidance calculates Celsius claims in dollars using account assets as of the July 13, 2022 bankruptcy filing. Current cryptocurrency prices therefore do not establish the claim amount used for distributions.
To assess a payment, compare the recognized claim amount with the applicable distribution terms and assets received. The difference between an original account balance and a payment does not, by itself, show that the administrator made a calculation error.
3. Claim Status and Distribution Eligibility

An earlier payment does not establish eligibility for every later distribution. The claim’s classification and rights under the plan determine which distributions may apply.
Different Classes Receive Different Treatment
Fourth-distribution guidance identifies eligible categories including General Earn, Retail Borrower Deposit, Withhold, Unsecured Loan, and General Unsecured Claims. Convenience, Custody, and De Minimis categories lack the relevant Illiquid Recovery Rights and do not qualify for that distribution.
An unresolved claim or outstanding Withdrawal Preference Exposure may also affect payment. Withdrawal exposure concerns potential recovery of certain prebankruptcy withdrawals; it does not itself mean the creditor committed fraud. A contested entitlement may require bankruptcy litigation review.
An “allowed” claim is a claim recognized for bankruptcy purposes. A creditor with an unresolved objection should distinguish that legal dispute from an unsuccessful transfer. Updating payment details may address delivery, but it does not resolve an objection to the claim.
Records to Check for Missing Payments
Compare official notices with your claim and payment records. A delivery problem requires a different response from an objection to the claim.
- Confirm the claim classification and allowed status.
- Review payment confirmations and outstanding requests.
- Update portal information and complete required identity checks.
- Preserve settlement elections and withdrawal-related correspondence.
For a payment failure, retain the attempted payment date, error message, and support ticket number. These details help the administrator identify the problem without requiring you to reconstruct the correspondence later.
4. Separate Claims Require an Independent Legal Basis
The Martin Act provides government enforcement authority but creates no private right of action. Otherwise valid independent common-law claims may remain available, subject to their own requirements.
The settlement’s preservation of private rights does not establish liability to each investor. Before pursuing securities litigation, review the defendant, supporting evidence, claim ownership, existing releases, and applicable deadlines.
That review should connect the alleged misconduct to the investor’s transactions and losses. Relevant materials may include statements received before depositing assets, transaction dates, and records showing how the investor acted on those statements. General allegations about Celsius cannot replace the requirements of a particular claim.
5. Frequently Asked Questions
Voting participation and relocation can affect questions surrounding distributions. Neither should replace a review of the creditor’s current claim records.
Generally, yes. Not voting does not itself prevent a distribution, although settlement opt-outs, withdrawal exposure, and other claim issues may affect timing.
Update your information through the official claims portal. Moving to a jurisdiction unsupported by your distribution partner may require reassignment, rather than a change to your underlying claim rights.
6. Legal Review of an Unresolved Recovery
An attorney can review a claim objection, withheld distribution, or withdrawal demand to identify the controlling documents and response deadline. For a separate lawsuit, the review should establish who holds the claim and whether existing agreements restrict it.
Bring the relevant notices and payment history to that review. The immediate task is to determine whether the unresolved issue concerns an administrative payment step, bankruptcy entitlement, or a separate legal claim.
