Tax Attorney Representation for EDD Payroll Tax Assessments

Tax attorney representation helps Los Angeles employers review disputed EDD payroll tax assessments, appeal deadlines, and collection exposure.

An alleged tax shortage may stem from omitted wages, contested worker status, or deposits credited to the wrong quarter. The employer must determine whether to correct a filing, challenge EDD's calculation, or address an established debt. Each route requires different records and procedural steps.

1. EDD Assessment Representation Begins with the Disputed Amount

The Employment Development Department (EDD) administers California's Unemployment Insurance (UI), Employment Training Tax (ETT), State Disability Insurance (SDI), and Personal Income Tax (PIT) withholding. An attorney's initial review should identify the employer, tax quarters, amounts disputed, and whether EDD is auditing, assessing, or collecting a liability.

Tracing Audit Findings to a Formal Tax Demand

An audit appointment or records request calls for a documented response, not an immediate petition. The auditor may examine wage reports, interview workers, or propose adjustments. A Notice of Assessment is different: it states an asserted liability and carries petition rights. A later collection notice generally does not restart the deadline for contesting that assessment. The notice itself, not a telephone conversation, establishes the immediate procedural question.

Correcting Returns without Losing Petition Rights

Employers generally report quarterly taxes on Form DE 9 and employee wages on Form DE 9C. EDD permits corrections through e-Services for Business, including changes to prior quarters. A DE 88 deposit error follows a separate adjustment process. Corrections should match the quarter and filing involved; changing a report does not substitute for a timely petition against an assessment. Separate CDTFA sales tax disputes use different forms and review procedures.

2. EDD Assessment Figures Must Match Employer Records

An EDD payroll tax case review tests the agency's figures against what the business paid, reported, and deposited. An effective file separates accounting discrepancies from legal disputes about taxable wages or employment status, rather than treating every difference as unpaid tax.

Testing the Tax Base and Payment Credits

Compare DE 9 and DE 9C filings with payroll registers, Forms W-2 and 1099, bank transfers, invoices, and EDD payment confirmations. For each disputed quarter, identify missing workers, duplicate payments, and deposits assigned to another period. Request the audit breakdown by worker and tax type. UI and ETT are generally employer-paid, while SDI and PIT are withheld from wages. Rates and wage limits depend on the year under examination; California removed the SDI wage ceiling beginning in 2024.

Assess Worker Classification under the Correct Test

A contractor agreement or Form 1099 does not decide whether EDD may assess employee wages. California Unemployment Insurance Code § 621(b) generally applies the ABC test to services performed from 2020 onward, subject to statutory exceptions that may require a different standard. Contracts, schedules, invoices, supervision records, and evidence of independent business activity matter more than titles. Federal payroll tax compliance rules are separate and should not be used as a substitute for California's test.

3. CUIAB Petitions Challenge Formal EDD Assessments

When EDD issues a Notice of Assessment, the dispute moves beyond exchanging documents with an auditor. A petition for reassessment is filed with the California Unemployment Insurance Appeals Board (CUIAB), an independent administrative review body. The petition should identify the contested liability and the factual or legal grounds for changing it.

Petition Deadlines and Filing Requirements

CUIAB generally allows 30 calendar days from the mailing date of an ordinary EDD tax notice to file a petition. A jeopardy assessment has an accelerated 10-calendar-day period. Limited late-filing relief may be available for an ordinary petition upon a showing of good cause, but employers should not rely on an extension. Include the EDD account number, notice date, disputed issues, contact details, and supporting notice. Follow the notice's filing instructions and retain proof of delivery to CUIAB's Office of Tax Petitions.

Hearing Preparation and Further Review

After EDD responds to the petition, CUIAB may schedule a hearing before an administrative law judge. Organize exhibits around the particular disputed finding, such as taxable wages, payments, or worker status. Witnesses and records should address the work actually performed, not simply repeat a contract label. A Board appeal may follow an adverse decision under separate deadlines. An EDD result does not control the separate EDD and IRS employment tax rules.

4. Collection Decisions Require a Separate Financial Review

Disputing liability and managing an unpaid balance are related but distinct decisions. An employer may need to address ongoing deposits and potential enforcement even while evaluating its procedural rights. Los Angeles business owners follow the same statewide EDD and CUIAB rules as other California employers.

Payment Arrangements and Interest Exposure

EDD offers payment plans for qualifying payroll tax balances. Its online option generally requires a balance of $50,000 or less, current tax returns and wage reports, and bank-account payments; other arrangements may require contacting its Tax Collection Section. Levies, liens, and asset seizures are possible collection measures. A petition does not stop interest from accruing. Paying a disputed assessment while a petition is pending may convert the matter into a refund claim without conceding the underlying liability.

Local Assistance Versus Petition Filing

EDD lists employment tax offices in Santa Fe Springs and Van Nuys for in-person assistance. Those offices are not interchangeable with CUIAB's Office of Tax Petitions in Sacramento, where written tax petitions are directed. IRS employment tax notices and Los Angeles city business tax matters involve other agencies and procedures. Confirm the addressee and submission method on each notice before filing documents.
