Criminal Defense Appeal Lawyer for Direct Appeals

مجال الممارسة:Criminal Law

Criminal defense appeal lawyer review focuses on preserved trial errors, the appellate record, and which claims can be raised on direct appeal.

A direct criminal appeal does not retry the case. The appellate court reviews the existing record to determine whether legal errors affected the conviction or sentence. Preserved objections, suppression rulings, jury instructions, sentencing issues, and some ineffective assistance claims can shape the scope of review.

1. What Can Be Challenged on a Direct Criminal Appeal?

A direct appeal examines a conviction or sentence through the record created in the trial court. It generally is not a proceeding for presenting new witnesses or rebuilding the case with evidence that never appeared below.

The starting point is identifying an issue the appellate court can decide from that record and determining what standard of review applies.

Trial and Sentencing Errors Raise Different Appellate Issues

Trial and Sentencing Errors Raise Different Appellate Issues

Potential appellate issues may arise from suppression proceedings, evidentiary rulings, jury instructions, legal sufficiency, sentencing, or other rulings reflected in the record.

IssueRecord an Appellate Attorney May Review
SuppressionMotions, hearing testimony, exhibits, and rulings
EvidenceObjections, offers of proof, and the judge's ruling
Jury instructionsRequests, objections, and the charge
SentenceSentencing submissions, statements, and the sentence imposed
Attorney performanceTrial record showing the challenged conduct

An unfavorable ruling does not automatically establish reversible error. The court also considers the governing legal standard and whether the error affected substantial rights.

Cases involving broader trial-stage issues may also relate to criminal defense and trials.

The Appellate Court Can Affirm, Reverse, or Modify

An intermediate appellate court can affirm a judgment or, when the legal requirements are met, reverse or modify it.

The proper result depends on the error. A prejudicial trial error may lead to a new trial. Legally insufficient evidence can require dismissal of an unsupported charge. A sentencing issue may result in modification or resentencing.

For that reason, an appellate argument should identify both the alleged error and the relief that follows if the court agrees.

2. Why Does Preserving an Issue at Trial Matter?

Many appellate arguments depend on what the defense placed on the record when the issue arose.

Under CPL § 470.05(2), a question of law is generally preserved when the party makes its position known while the trial court still has an opportunity to change the ruling or instruction.

The Trial Record Must Show the Legal Position

An objection does not need a particular label. What matters is whether the record adequately shows the position the defense asked the trial court to consider.

Preservation may depend on an objection to evidence, a requested jury instruction, a motion, or another timely challenge to the court's ruling.

This is why appellate review usually begins with transcripts, motions, and rulings rather than the judgment alone.

Related issues may fall within a broader criminal appeals review.

Unpreserved Claims Face a Different Standard

If an issue was not properly preserved, ordinary review as a question of law may be unavailable.

An intermediate appellate court has discretion to address some unpreserved errors in the interest of justice. That authority does not make preservation optional, and a defendant cannot assume the court will reach an unpreserved claim.

The preservation question should therefore be resolved before the appellate brief relies heavily on a particular trial error.

3. How Does the Direct Criminal Appeal Process Move Forward?

A notice of appeal begins the process, but it is not the appellate argument itself. The record and brief come later.

For an ordinary appeal from a judgment or sentence, CPL § 460.10 generally requires a notice of appeal to be filed within 30 days after sentencing and served as required by the statute. Late-filing issues involve separate rules and are not the focus of this page.

Build the Appeal from the Existing Record

The attorney should identify the materials needed to evaluate each proposed issue, including:

  • Trial and hearing transcripts;
  • Motions and written decisions;
  • Exhibits included in the record;
  • Jury instructions and objections;
  • Sentencing materials; and
  • The judgment and relevant orders.

The appellate brief then connects each argument to the record, explains whether the issue was preserved, and identifies the relief authorized if reversible error is found.

General appellate procedure may also overlap with the firm's appeals practice.

4. Can Ineffective Assistance Be Raised on Direct Appeal?

Sometimes. The key question is whether the existing record contains enough information to evaluate the attorney's performance.

A defendant may believe the trial lawyer made a serious mistake, but not every ineffective assistance claim can be resolved on direct appeal.

Record-Based Claims May Be Reviewed on Appeal

A direct appeal may address ineffective assistance when the alleged deficiency and the facts needed to evaluate it appear in the trial record.

The state standard examines whether the representation was meaningful when viewed in the context of the case as a whole. Federal constitutional principles may also apply depending on the claim.

The appellate court should not have to speculate about facts that were never developed in the trial court.

Off-Record Claims May Require a Cpl 440.10 Motion

Some claims depend on facts outside the record, such as private attorney-client communications, investigation decisions, preparation, or the reasons for a particular strategy.

CPL 440.10 provides a separate route for claims that require facts the appellate record cannot adequately show. A claim involving both record and nonrecord facts may also require post-conviction review rather than resolution solely through the direct appeal.

Choosing the correct procedure matters because an appellate court generally decides the direct appeal from the record before it.

5. Frequently Asked Questions

How Many Times Can You Appeal a Criminal Case?

There is no fixed number of automatic appeals.

A defendant may have an appeal as of right to an intermediate appellate court depending on the judgment and court involved. Further review by the state's highest court generally requires permission and is subject to its own jurisdictional limits.

Losing the first appeal therefore does not automatically create another appeal as of right.

Can the Prosecution Appeal in a Criminal Case?

Yes, but only in circumstances authorized by statute.

CPL § 450.20 identifies specific orders and sentences from which the prosecution may appeal, including certain dismissal, suppression, and post-judgment orders. It does not create a general right to challenge every unfavorable ruling.

Constitutional limits, including double jeopardy principles, may also restrict what the prosecution can obtain through an appeal.

6. When Should a Criminal Appeal Attorney Review the Record?

Appellate review may be useful when a defendant identifies a suppression ruling, trial objection, jury instruction, sentencing issue, or possible attorney error but does not know whether the claim was preserved or belongs in another post-conviction procedure.

A criminal appeal attorney can compare the proposed issues with the transcripts, motions, rulings, and judgment to determine which claims fit within the direct appeal and which may require a separate procedural route.
