Customs Seizure Letters after Black Friday Online Purchases

المؤلف : Donghoo Sohn, Esq.

Customs seizure letters require checking the notice, stated reason, and response options before acting on a payment request.

A stalled overseas order and a message demanding extra duties do not establish that CBP seized your package. Verify the request through official CBP or carrier channels. If a seizure notice is genuine, check its deadline and gather purchase, payment, shipping, and authenticity records to prepare your response.

1. Is Your Package Delayed, Detained, or Seized?

A tracking update such as “clearance delay” does not establish the package’s legal status. Identify what the carrier or U.S. Customs and Border Protection (CBP) actually requested.

Separate Clearance Problems from a Seizure Notice

Missing invoices, unpaid duties, or inspection can delay release. Detention holds goods for further review. Seizure means the government has taken custody based on an alleged violation. Forfeiture is the process through which ownership can pass to the government.

Supplying an invoice may address a documentation hold. A seizure notice requires reviewing the alleged violation and procedures under federal customs law. Paying duties does not necessarily resolve concerns involving counterfeit or prohibited goods.

Establish What Happened to This Shipment

Compare the tracking number, seller, and package description across your order and carrier records. Ask the carrier whether it needs clearance documents, payment, or a response to an agency notice.

If the seller says “customs seized it,” request the underlying communication. CBP does not operate a general parcel-tracking service. Carrier records and agency correspondence provide a stronger starting point than the seller’s explanation alone.

2. Verify the Letter and Any Additional Payment Request

A genuine shipment problem can coincide with a scam message. Verify the agency communication and carrier bill separately.

Use Independently Located Contact Information

Open the carrier’s official app or website directly. Locate CBP contact information through its official website. For an apparent seizure, confirm the responsible Fines, Penalties, and Forfeitures (FP&F) office before providing the case number.

A logo, employee name, or apparent government email address does not establish authenticity. Scammers can copy official details. Demands for gift cards, cryptocurrency, or a wire transfer to resolve a supposed CBP enforcement matter are scam indicators. Avoid links and callback numbers in suspicious messages.

Read the Notice against Your Order

Check the property description, seizure date and location, alleged violation, case number, response instructions, and deadlines. Keep the envelope because the mailing date may affect the filing period.

For a carrier bill, ask whether the amount covers duties, taxes, brokerage, or another service charge. Carriers may legitimately collect import-related charges. However, paying a verified carrier bill does not itself obtain release of seized property.

3. Build a File That Connects the Purchase to the Package

Your submission should address the reason given in the notice. A receipt may establish a purchase without proving authenticity, lawful importation, or your interest in the goods.

Match Each Record to the Disputed Issue

Organize documents by what they establish. Different records answer different questions.

RecordWhat It Can Help EstablishLimitation
Invoice and order confirmationItem, seller, quantity, and priceMay not establish authenticity
Payment statementAmount paid and transaction dateMust connect to the order
Shipping recordTracking number, sender, and recipientMay not establish ownership
Product listing and seller messagesAdvertised brand, condition, and termsSeller claims may need independent support
Authentication or brand recordsGenuine manufacture or authorized sourcingMust relate to the seized item

Preserve the Black Friday promotion, coupon, and checkout total. If declared value is questioned, customs valuation analysis may require reconciling the invoice, payment, and declaration. A discounted price alone does not establish undervaluation.

Keep original files and explain discrepancies. Do not alter receipts or ask the seller to backdate documents.

Identify the Buyer, Owner, and Importer

The recipient, purchaser, owner, and importer shown in shipment records may differ. A gift, shared payment account, or forwarding service can explain those differences, but document the relationship.

Identify who paid, who owns the goods, and who appears on the customs paperwork. A person petitioning for seizure relief must establish a qualifying interest in the property. A name on the delivery label does not settle that question.

4. Choose a Response before the Applicable Deadline

For a genuine customs seizure letter, the response depends on the seizure authority, your interest in the goods, and the relief sought.

Distinguish a Petition from a Claim

A petition asks CBP for administrative relief from forfeiture. Explain the facts, address the alleged violation, and attach supporting records. Under 19 CFR § 171.2, seizure petitions generally must be filed within 30 days after the notice is mailed. Extensions and a limited shorter-deadline exception exist, so check the notice.

A claim seeks judicial forfeiture proceedings. For non-CAFRA customs forfeitures, the claim period generally runs 20 days from first publication, with a cost bond unless waived. Claims covered by the Civil Asset Forfeiture Reform Act generally have a different, 35-day period measured from mailing of the notice and require no bond. Confirm which framework applies.

An information request or carrier call does not replace a filing. Keep submission confirmations and do not assume an extension request has been granted. Filing a claim does not itself entitle you to possession of the goods.

What Happens If You Ignore a Customs Seizure Letter?

Ignoring a genuine notice can allow administrative forfeiture to proceed and may eliminate opportunities to contest the loss. Depending on the goods and applicable law, the government may sell, destroy, or otherwise dispose of them. Return to the seller is not assured.

A seizure notice does not establish a criminal conviction. Choosing not to seek the goods also does not automatically resolve a separate penalty or investigation.

If a deadline is close, ownership is unclear, or the notice alleges more than missing paperwork, an attorney can assess the customs compliance and enforcement issues. Bring the notice, envelope, purchase records, and carrier communications for review before choosing a response.
