When Is a Living Trust Better Than a Will?

Living trust planning in Queens: Compare wills and revocable trusts, probate, incapacity, costs, funding, and trustee duties under New York law.

A revocable trust may be better when assets need management during incapacity, beneficiaries need staged payments, or probate complicates transfers. A will may suffice when assets already pass outside probate. The choice turns on ownership, costs, privacy, and management.

1. When Is a Trust Worth More Than a Will?

A trust allows lifetime management and may avoid probate; a will directs probate assets at death.

Incapacity and Minor Children

A successor trustee may manage funded assets during incapacity under the trust's terms. A will grants no lifetime authority; a durable power of attorney may cover assets outside the trust.

A will can nominate guardians; a trust can control when children inherit. Testamentary succession planning may therefore complement a trust.

Privacy and Cost

A probated will generally becomes a public court record. A trust need not be routinely filed, although recorded deeds remain public and litigation may disclose trust terms.

Drafting, retitling, and administration cost money. Existing beneficiary designations or survivorship ownership may make a will more economical.

2. What Makes a Living Trust Legally Effective?

Signing a trust and funding it are separate steps. Funding determines what avoids probate.

Execution and Revocation

EPTL §7-1.17 requires a written trust signed by its creator and, unless the creator is sole trustee, at least one trustee. Execution requires acknowledgment as for recording a deed or signatures before two subscribing witnesses.

EPTL §7-1.16 makes lifetime trusts irrevocable unless expressly revocable. A revocable trust may also be changed by an express direction in a will identifying the trust or affected provision; other authorized amendments ordinarily follow §7-1.17's written formalities.

Funding Property and Pour-over Wills

Under EPTL §7-1.18, listing assets in the agreement does not transfer them. When the creator is sole trustee, registrable property needs deed recording or registration in the trust's or trustee's name; other assets need a written assignment identifying them specifically.

Queens County deeds are recorded with the NYC City Register through ACRIS. Co-op transfers involve shares, proprietary leases, and possible approvals, so real estate transfer review is relevant.

A pour-over will directs leftover probate property to the trust but does not itself avoid probate. Beneficiary-designated assets may already transfer separately.

3. What Does a Revocable Trust Not Accomplish?

Control over trust assets carries financial consequences. Probate avoidance does not automatically produce tax savings, Medicaid eligibility, or creditor protection.

Estate Tax and Medicaid

Under IRC §2038, assets subject to a retained power of revocation generally enter the federal Gross estate, not necessarily the Taxable estate. New York estate tax is separate, and creating a revocable trust alone does not reduce either tax.

Under 42 U.S.C. §1396p(d)(3)(A), an individual's self-funded revocable trust corpus generally counts as available resources for Medicaid. Irrevocable trusts require separate elder law analysis.

Creditors and Spousal Rights

EPTL §7-3.1 generally exposes self-settled trust assets to the creator's creditors, subject to statutory exceptions. Under EPTL §5-1.1-A, a surviving spouse's elective share may also reach qualifying lifetime transfers treated as testamentary substitutes.

4. What Happens When the Trustee Takes Control?

The successor trustee identifies assets, reviews liabilities, keeps accounts, and distributes under the agreement. Distribution rights depend on trust terms and law.

Fiduciary Duties and Disputes

EPTL §11-1.7 bars clauses excusing failure to exercise reasonable care, diligence, and prudence. EPTL §7-2.6 addresses removal in Supreme Court; SCPA §711(11) and §1509 provide relevant Surrogate's Court authority over lifetime trustees.

SCPA §§2205–2206 govern compulsory accountings and relief. A petitioner must have standing as a person interested or another authorized applicant, not merely a family connection.

Probate Venue and Electronic Filing

SCPA §205 generally places estate probate in the county of domicile at death. SCPA §207 separately links lifetime-trust jurisdiction and venue to New York trust assets or, at commencement, the grantor's domicile or an acting trustee's residence or principal office.

Queens County Surrogate's Court ordinarily requires NYSCEF filing for new probate, accounting, and miscellaneous proceedings. Unrepresented litigants can claim exemption, as can qualifying attorneys. Forming a trust itself requires no routine court registration.

5. Frequently Asked Questions

How Much Does a Living Trust Cost in New York?

No statewide attorney fee applies. Drafting, retitling, and administration vary by estate. Compare total expense with likely probate costs.

Does Divorce Cancel a Living Trust?

Not necessarily. EPTL §5-1.4 generally revokes certain revocable benefits and fiduciary nominations for a former spouse unless the instrument provides otherwise. Review beneficiaries and successor trustees.

6. Reviewing Your Estate Planning Choice

Compare titles, beneficiary designations, funding, trustees, and costs. A living trust lawyer in Queens can assess whether a will, funded revocable trust, or both meet those needs without treating probate avoidance as a universal advantage.
