1. Once an Objection Is Filed, the Probate Case Changes


An objection to a petition or other request for relief can turn routine administration into a contested proceeding. First identify who has an affected interest, what is challenged, and whether the will has been admitted.



Standing and Timing Depend on the Stage of Probate


Probate Code § 48 defines an interested person broadly, but standing depends on the issue. Before admission, § 8250 requires an objection, summons, and service in a will contest. The summons directs a served person to file a written response within 30 days.

2. What Happened Around Signing Often Drives the Will Contest


An unexpected distribution does not invalidate a will. At trial, § 8252 places the burden of due execution on the will's proponents and places the burden for challenges such as lack of capacity, undue influence, fraud, duress, mistake, or revocation on the contestants.



Execution and Capacity Are Separate Issues


Probate Code § 6110 sets the ordinary writing, signature, and witness rules, while § 6100.5 addresses testamentary capacity when the will was made. A document can raise one issue without raising the other.

Undue Influence Requires Evidence Beyond Suspicion

Under Probate Code § 10950, the court may order an account on its own motion or on petition of an interested person. Section 8502 permits removal for waste, embezzlement, mismanagement, fraud, inability to perform, neglect, or other statutory grounds.

  • Do not treat independent authority as a ruling on a disputed claim.
  • Separate routine administration from issues that require a court decision.

Case Management Creates Its Own Calendar


If a contested matter is set for a Case Management Conference, attorneys generally must meet and confer no later than seven days beforehand. Unless excused, they must also serve and file the Case Management Statement four court days before the conference.

  • Original wills and codicils are not eligible for ordinary e-filing.


Settlement Is Built into the Local Trial Track

  • Define the property, claims, and requested relief before negotiations.
  • Keep administration moving when the dispute does not require a stay.

5. Frequently Asked Questions


How long can someone wait to challenge a will after it is admitted?

Probate Code § 8270 generally allows an eligible interested person 120 days after admission to petition to revoke probate. The statute excludes certain people who already participated in or had actual notice in time to join an earlier contest.


Can a small estate procedure avoid a disputed inheritance case?

Not necessarily. For deaths on or after April 1, 2025, the adjusted § 13100 personal-property affidavit limit is $208,850, subject to statutory exclusions and requirements. A simplified transfer procedure does not decide a genuine dispute over ownership or succession.


Does a living trust guarantee that the family stays out of court?

No. Properly funded trust assets may avoid probate administration, but trust validity, trustee conduct, or beneficiary disputes can still lead to litigation.


How long does a creditor have to file a probate claim?

Probate Code § 9100 generally uses the later of four months after letters are first issued to a general personal representative or 60 days after notice of administration is mailed or personally delivered, subject to other limitation rules.
