Tax Attorney in Southern California Explains IRS Notice Options

A tax attorney in Southern California can help identify whether an IRS or state tax notice requires records, payment, or an appeal.

Check the issuing agency, tax year, notice number, and response date before taking action. An IRS audit letter, a collection notice, and a proposed assessment follow different procedures. State tax notices may carry separate deadlines.

Contents

1. What Does the Tax Notice Actually Require?

A letter questioning income is different from a demand for overdue tax. Before paying or replying, check the issuing agency, notice number, tax year, and deadline. Those details point to the proper procedure.

Separate Return Errors from an IRS Examination

The IRS may send CP2000 when income reported by an employer or bank differs from a return. It proposes an adjustment, not a bill or an audit.

  • CP2000: Compare Forms W-2 and 1099 with the return, then follow the stated response instructions.
  • Audit letter: Identify the disputed items, records, and deadline.
  • Discovered error: Check whether an amended return is appropriate; do not assume a CP2000 requires one.

Explain only the questioned items and preserve supporting records. For a formal examination, the firm's tax audits and adjustments resource explains the separate process.

Build a File Around the Notice, Not the Entire Tax History

Keep the envelope, notice pages, and proof of any reply. Do not mix records from different tax years.

RecordWhat to Verify
Agency noticeNotice number, tax year, deadline, and reply address
Filed returnReported income, payments, credits, and deductions
Third-party formsAmounts reported by employers, banks, or customers
Business booksLedger entries, invoices, receipts, and reconciliations

Save a dated response and delivery confirmation. Tie each explanation to supporting records.

2. Does the Notice Concern Tax Debt or a Proposed Assessment?

A proposed adjustment is not the same as an assessed balance. A collection letter addresses payment; a statutory Notice of Deficiency creates a Tax Court petition window. Read the notice before choosing a response.

Check Collection Rights before a Levy

A federal tax lien secures a debt against property. A levy can take wages or bank funds. Each requires a different response.

  • Balance due: Compare the assessment with payments and identify any missing returns.
  • Final levy notice: For notices offering Collection Due Process rights, request a hearing using Form 12153 generally within 30 days of the notice date.
  • Financial hardship: Review whether an installment agreement or another collection alternative is available.

CP504 and notices such as Letter 1058 do not provide identical hearing rights. The firm's tax debt resolution page addresses payment options and collection measures.

Distinguish Federal Deficiency Notices from State Proposals

An agency's notice controls the next filing step. The periods below are not interchangeable.

  • IRS Notice of Deficiency: A Tax Court petition is generally due within 90 days after mailing, or 150 days when the notice is addressed outside the United States.
  • FTB Notice of Proposed Assessment: Protest within the stated period, generally 60 days. An adverse Notice of Action may permit a separate 30-day OTA appeal.
  • CDTFA Notice of Determination: A sales or use tax redetermination petition is generally due within 30 days after mailing; special notices may differ.

Sending documents to another agency does not preserve the deadline. State disputes follow separate procedures; see state tax issues.

3. Where Should a Taxpayer File a Challenge?

IRS deadlines do not change by city. The Franchise Tax Board (FTB) handles state income and franchise taxes, while the California Department of Tax and Fee Administration (CDTFA) handles sales and use taxes. County boards review property assessments.

Choose the Correct Review Path and Preserve Deadlines

First identify the agency with authority over the tax. A protest, administrative appeal, and court petition are separate filings.

  • IRS assessment dispute: IRS Appeals may review qualifying disputes, but an Appeals request does not replace a timely Tax Court petition.
  • State income-tax dispute: File an FTB protest as directed; an unfavorable Notice of Action may be appealable to the Office of Tax Appeals.
  • Sales-tax dispute: File the CDTFA redetermination petition through the prescribed channel, not an IRS appeal.

For regular 2026 assessments, Los Angeles and San Diego counties accept appeals from July 2 through November 30. Other counties may use a September 15 cutoff. Special assessments follow different deadlines. Litigation issues are addressed under tax controversy and litigation.

Confirm the Filing Destination and Evidence Needed

A filing sent to the correct agency but by an unauthorized method may cause problems. Check the permitted method.

  • Federal petition: Follow U.S. Tax Court filing rules; replying to the IRS is not a court petition.
  • State protest: Use the prescribed online, mail, or other accepted method and retain proof of timely submission.
  • County appeal: Apply through the county assessment appeals board or clerk, rather than sending an appeal only to the assessor.

Verify the year and requested remedy. Save proof of filing.

4. Frequently Asked Questions

Can a taxpayer request penalty relief without contesting the tax?

Sometimes. Certain penalties may qualify for reasonable-cause relief or applicable administrative relief, even when the underlying tax remains due.

Can spouses disagree with a tax assessment on a joint return?

Joint filing can create joint and several liability. In qualifying circumstances, one spouse may request relief under federal innocent spouse rules.

Can a taxpayer authorize an attorney to speak with the IRS?

Yes. Form 2848 generally authorizes an eligible attorney to represent the taxpayer for specified matters and periods. It does not extend statutory deadlines.

Does filing an extension also extend the tax payment deadline?

Generally, no. An extension to file a federal income tax return does not extend the original payment deadline. Interest and penalties may apply to unpaid amounts.

5. Review Your Tax Notice with Sjkp Attorneys

A tax notice may arrive while other bills remain unpaid, but the amount alone does not explain the available response. SJKP's attorneys can review the notice, tax records, and filing options. Contact SJKP with the agency name, disputed year, and response date to discuss the next step.
