Mocra Compliance for Cosmetic Brands and Fda Enforcement Risks

MoCRA compliance requires cosmetic businesses to meet facility registration, product safety, adverse event reporting, and FDA records-access obligations.

A private-label brand may retain federal duties even when another company manufactures its products. Missed filings, inadequate safety records, or serious complaints require identifying the responsible entity, applicable deadlines, and records FDA may request.

1. Who Is Responsible for Mocra Compliance?

Facility operators and label-identified responsible persons have separate duties. Contracts can delegate tasks but do not automatically transfer statutory responsibility.

Facility Operators and Private-Label Brands

Under FD&C Act §604, the responsible person is the labeled manufacturer, packer, or distributor. Facility operators register covered manufacturing sites; responsible persons handle product listings, safety substantiation, and serious adverse event reports.

Under §607(a)(3), a contract facility needs only one registration even when serving multiple brands. A responsible person whose products it manufactures may submit that registration.

Small Business Exemptions

Section 612 generally exempts businesses averaging under $1 million in gross annual U.S. .osmetic sales over the preceding three years, adjusted for inflation, from registration, listing, and MoCRA GMP requirements.

Exceptions cover specified eye mucous-membrane products, injectables, internal-use products, and appearance changes lasting over 24 hours without customary removal. Safety, labeling, and adverse event duties generally remain.

2. Facility Registration, Product Listing, and Safety Requirements

Facility and label records determine which filings need correction. Registration and product listing have separate deadlines.

Registration and Listing Deadlines

New covered facilities generally register within 60 days of starting manufacturing or processing for U.S. .istribution, renew biennially, and update changed information within 60 days.

Responsible persons list new products within 120 days of first marketing in interstate commerce and update listings annually. Before corrective filing, compare submissions with launch dates and labels. Some products need separate FDA registration review.

Safety Substantiation and Labeling

Section 608 requires scientific evidence supporting a reasonable certainty of safety under labeled or customary conditions of use. Formulation data, testing, and supplier records may support the assessment, but supplier documentation alone does not establish finished-product safety.

Labels need required domestic adverse event contact details. Professional-use products and drug claims may require additional labeling review. MoCRA GMP and fragrance-allergen regulations remain unfinalized.

3. Serious Cosmetic Adverse Event Reporting Requirements

Responsible persons must report qualifying serious events within 15 business days of receiving the report. Conclusive proof of causation is not required.

Reportable Serious Events

FD&C Act §§604–605 cover death, life-threatening experiences, inpatient hospitalization, significant disability, congenital anomalies or birth defects, infection, significant disfigurement, serious persistent rashes, second- or third-degree burns, significant hair loss, and qualifying preventive medical intervention.

The initial FDA report must include a copy of the retail product label.

Follow-Up Reporting and Records

New and material information received within one year of the initial report must be submitted within 15 business days. Records of serious and non-serious adverse events generally must be retained for six years, or three for qualifying small businesses.

Under §605(f), FDA may require fragrance or flavor ingredient information within 30 days when statutory conditions are met.

4. How Can Fda Enforce Mocra Violations?

Records access, facility suspension, and mandatory recall have separate legal thresholds. A late filing alone does not establish a serious product safety risk.

Registration Is Not Fda Approval

Registration and listing do not constitute FDA approval or product clearance. FDA does not issue compliance certificates for these filings.

Inspection and Records Access

Section 605 permits inspection of required adverse event records. Under §610, FDA may access additional relevant records when it reasonably believes a cosmetic is likely adulterated and its use poses a threat of serious adverse health consequences or death, subject to statutory limits.

FDA's January 2026 records-access guidance remains a draft, not a binding final rule. Businesses responding to FDA inquiries should preserve records and assess the request's scope.

Facility Suspension and Mandatory Recall

Section 607 permits registration suspension when a product presents a reasonable probability of serious harm or death and a non-isolated or pervasive failure raises concerns about other products.

Section 611 separately addresses qualifying adulterated or misbranded cosmetics presenting serious risks. FDA must offer an opportunity for voluntary cessation and recall before ordering distribution stopped, followed by an opportunity for an informal hearing within ten days. The agency may then require a recall.

5. Frequently Asked Questions

Do Foreign Cosmetic Manufacturers Need a U.S. Agent?

Yes. Covered foreign facilities must identify a U.S. .gent in their registration. That appointment does not transfer statutory obligations.

What If a Brand Misses a MoCRA Filing Deadline?

Identify the overdue submission, responsible entity, and supporting records. Corrective filing may be necessary, but late compliance does not eliminate potential exposure for earlier violations.

6. When to Consult a Mocra Compliance Attorney

Overdue filings, deficient safety records, serious complaints, or FDA requests call for reviewing filing histories, formulations, supplier agreements, and complaint timelines. A MoCRA compliance attorney can assess reporting duties, corrective submissions, and responses to enforcement inquiries.
