How Do New York City Domestic Violence Cases Proceed in Two Courts?

Área de práctica:Criminal Law

New York City domestic violence cases can involve separate criminal and Family Court proceedings, each with its own legal requirements.

If you face criminal charges and receive a Family Court petition, check each case’s appearance dates and protection orders. An outcome in one proceeding does not automatically resolve the other. Follow each order while it remains in effect, including any court-approved changes.

A criminal prosecution and a civil family offense proceeding can address the same alleged conduct. Overlapping jurisdiction depends on the offense and the parties’ relationship. You may be the criminal defendant and the Family Court respondent, with separate obligations in each case.

Check the Charge and Relationship

“Domestic violence” is not a single criminal offense. The accusatory document identifies the actual domestic violence charges, such as assault, menacing, or criminal obstruction of breathing.

CPL § 530.11 and Family Court Act § 812 establish overlapping jurisdiction for specified offenses involving qualifying relationships. These include spouses, former spouses, people with a child together, and qualifying current or former intimate partners. An intimate relationship does not require marriage or shared residence.

These are state proceedings. Federal prosecution requires a separate federal legal basis.

Different Proof Standards Apply

At a criminal trial, the prosecution must prove each offense’s elements beyond a reasonable doubt. The complaining witness cannot personally withdraw the charges.

Family Court applies a fair preponderance of the evidence standard at a family offense fact-finding hearing. This is a lower threshold than the criminal trial standard.

A temporary protection order does not establish criminal guilt. Dismissal of criminal charges does not automatically dismiss the family offense petition or terminate its separate order.

2. Confirm the Court and Next Appearance

Use each document’s heading, case number, and appearance instructions to identify where you must attend. Criminal and Family Court cases may have different calendars and courtrooms. Attending one appearance does not excuse the other unless the court directs otherwise.

Criminal Court and Family Court Follow Separate Procedures

Criminal cases commonly follow an NYPD investigation and arrest, with the appropriate county District Attorney handling prosecution. At arraignment, the court addresses the charges, attorney representation, release conditions, and any temporary protection order.

NYC Criminal Court handles misdemeanors, lesser offenses, and initial proceedings in many felony cases. Felony prosecutions generally proceed in Supreme Court after indictment or another authorized charging process.

A family offense case begins through a separate petition. Read the petition, summons, and temporary order together. Family Court Act § 262 provides appointed representation for eligible respondents who cannot afford an attorney.

Idv Court Assignment Is Not Automatic

An Integrated Domestic Violence Court may bring related criminal, family, and matrimonial matters before one judge. The court determines eligibility and transfer. Each proceeding retains its own legal standards.

If appearance dates conflict, notify your attorney and the courts promptly. Keep the scheduled dates unless you receive an authorized change.

3. Which Protection Order Terms Must You Follow?

Compare each order’s protected people, expiration date, restrictions, and exceptions. A criminal protection order under CPL § 530.12 may coexist with a Family Court order. Permission in one does not necessarily authorize conduct that another prohibits.

Contact, Housing, and Child Exchanges

A stay-away order may exclude you from a shared home even if you own it or appear on the lease. A limited order may prohibit specified conduct without requiring complete separation.

Read the protection order before replying to messages, collecting belongings, or arranging child exchanges. The protected person’s invitation does not suspend its restrictions.

Check whether a custody or visitation arrangement fits the contact restrictions. Request clarification or an express exception rather than assuming the parenting schedule overrides another order.

Ask the Issuing Court for Changes

A modification request generally goes to the court that issued the order. Family Court cannot simply cancel a criminal court order.

Identify the practical problem, such as retrieving medication or arranging a child exchange, and provide the relevant orders. Filing a request does not change the restrictions. Obtain the court’s decision before acting on a proposed exception.

4. Prepare Records for Both Proceedings

Separate court papers by case and organize evidence by incident date. This helps an attorney compare allegations and identify missing information. Preserve originals, and distinguish what you personally observed from what someone else reported.

Keep Court Papers and Earlier Orders

Gather:

  • Criminal charging papers and the family offense petition.
  • Current and earlier protection orders.
  • Appearance notices, release conditions, and court decisions.
  • Service records and related custody or visitation orders.

Flag inconsistent dates, incident descriptions, or contact exceptions. Keep dismissal documents, but confirm the other case’s status separately.

Preserve Evidence and Review Statements

Save complete message threads, photographs, recordings, and relevant records you lawfully possess. Retain original files and dates where possible. Identify witnesses or nearby cameras without contacting the protected person or pressuring witnesses.

Discuss proposed statements or testimony with your attorney. Statements in a civil proceeding may affect a criminal case; Family Court’s civil status does not eliminate self-incrimination concerns.

A New York City domestic violence lawyer reviewing your domestic violence defense should receive papers from both cases. Ask which allegations need a response and whether a separate application is required in either court.
