Chargeback Fraud after Black Friday and Evidence Sellers Need

Domaine d’activité :Criminal Law

Chargeback fraud responses depend on matching transaction, customer contact, and delivery records to the buyer’s claim.

A holiday-sale chargeback may reflect a valid complaint, confusion, or deliberate misuse. New York businesses working with agencies or platforms should identify who holds the records and handles the response. Legal review can clarify disputed facts, contract responsibilities, and available remedies.

Contents

1. Is the Chargeback Fraud or a Legitimate Purchase Dispute?

Start with the stated dispute reason. Unauthorized payment, nonreceipt, product defects, and missing refunds require different responses.

Separate Returns, Billing Confusion, and Deliberate Misuse

A return request under the published policy is not fraud merely because the item was discounted. Billing-name confusion or duplicate charges can also explain a dispute. Deliberate misuse involves knowingly misrepresenting material facts to reverse a valid charge.

The label “friendly fraud” does not establish intent. A receipt acknowledgment may contradict a nonreceipt claim, but check whether both concern the same shipment.

Check the Seller’S Obligations First

General Business Law § 218-a governs the applicable state refund-policy disclosures. Online retailers must conspicuously display or link to their policies near the item or before requesting billing information. Relevant terms include sale-item exclusions, return periods, and restocking fees. A final-sale label does not eliminate separate rights concerning unauthorized charges or undelivered goods.

Separately, the federal FTC merchandise-order rule requires a reasonable basis for shipment promises on covered orders. A missed shipping deadline generally requires offering the buyer a delay option or canceling and promptly refunding the unshipped order.

2. Match Merchant Evidence to the Buyer’S Claim

Link the order, payment, messages, shipment, and refunds in one timeline. Preserve original records and identify the agency, platform, or fulfillment provider supplying them.

Transaction Approval and Buyer Communications

A payment approval code does not conclusively establish the cardholder’s authorization. Authentication results, account activity, and order messages provide context under applicable network rules.

Keep complete, dated messages about address changes, delivery instructions, cancellations, and returns. Silence or failure to contact the seller first does not establish fraud.

Delivery Records and Their Limits

Tracking should connect the disputed order to the package, destination, and delivery event. A shipping label shows preparation for shipment, not carrier acceptance or receipt. Delivery photographs, signatures, and carrier investigations may resolve gaps.

Use the records that address the actual allegation:

Buyer’S ClaimUseful RecordsWhat Still Needs Checking
Payment was unauthorizedAuthentication results, account access, order messagesWhether the cardholder authorized the transaction
Item never arrivedCarrier scans, delivery address, signature or photographMisdelivery, split shipments, or missing contents
Item differed from the offerDated listing, product details, fulfillment recordsWhat was promised and what was supplied
Refund never appearedRefund date, amount, transaction referenceWhether the credit completed and covered the disputed amount

Preserve the Black Friday or Cyber Monday listing shown at purchase. If an agency changed product claims or shipping promises, advertising compliance review may identify a separate issue behind the complaint.

3. Respond through the Correct Dispute Channel

Respond through the acquiring bank, processor, or platform specified in the notice. Confirm the category, required documents, deadline, and submission authority.

Follow the Merchant’S Actual Submission Deadline

Do not borrow a consumer’s federal notice period as the merchant’s response deadline. Regulation Z generally gives consumers 60 days after transmission of the first statement showing a billing error to submit qualifying written notice. Merchant response windows arise separately under network rules and processing arrangements.

Address the claim directly with labeled records. Reconcile partial shipments and refunds with the disputed amount. Save the submission and confirmation because later stages may limit additional evidence.

Distinguish the Card Decision from Further Recovery

Customer discussions do not automatically pause the response window. If the buyer promises to withdraw the dispute, verify the processor’s required steps rather than assuming the case has closed. Coordinate any refund with the processor to avoid duplicate credits.

A chargeback decision does not automatically resolve a separate contract claim. Further payment disputes may require review of the underlying obligation, contractual forum, costs, and available remedies. A police report does not replace a chargeback response or guarantee investigation or repayment.

4. Review Platform and Agency Responsibility before Escalating

Identify the merchant of record, the entity responsible for the sale in the payment arrangement, and who holds the funds. Campaign participation alone does not establish responsibility for a chargeback.

Records, Submission Authority, and Loss Allocation

Review platform terms and advertising agency agreements for obligations tied to the disputed orders:

  • Records access: Export rights, retention periods, and cooperation after termination.
  • Response authority: Who receives notices, submits evidence, and approves settlements.
  • Financial responsibility: Chargeback amounts, fees, reserves, indemnity, and liability limits.
  • Campaign approval: Responsibility for product descriptions, return terms, and delivery promises.

Reimbursement depends on the agreement, conduct, and applicable law. Check whether indemnity covers direct losses, third-party claims, or dispute fees.

Define the Legal Review Around the Disputed Orders

Give the attorney the notice, timeline, original offer, correspondence, delivery records, and contracts. Flag the earliest deadline and funds on hold.

The review can address accepting or contesting the chargeback, obtaining partner records, or pursuing a separate claim. Compare individual orders before alleging a coordinated scheme.
