Korean Lawyer Explains What to Check in English Legal Documents

Domaine d’activité :Others

A Korean lawyer can help you identify what an English legal document requires, whether a response deadline applies, and what to ask before signing.

A court summons, demand letter, and contract may call for very different responses. Bring the original document, any envelopes, and related messages to your first consultation. A Korean-speaking attorney can explain the legal effect of the wording, not simply translate it.

An English notice may look official even when it comes from a private business. Check who sent it, what action it requests, and whether a court case exists. A lawsuit, demand letter, and proposed agreement require different decisions.

Is It a Court Filing or a Private Demand?

A summons and complaint usually identify a filed lawsuit. A demand letter may seek payment without starting one. Do not assume a deadline set by the sender carries the force of a court order.

DocumentWhat to Check
Summons and complaintCourt, case number, parties, and service
Demand letterClaim, requested action, sender, and stated date
Proposed agreementObligations, signature terms, and effective date

Which Pages and Attachments Matter?

An exhibit or a paragraph near the signature line may change what the document asks you to accept. Keep the complete packet, even if someone translated a few pages.

  • Preserve every page, attachment, and envelope.
  • Record when and how the papers arrived.
  • Mark unfamiliar terms without altering the original.

For filed lawsuits, read about civil litigation.

2. How Do You Check a Deadline Written in English?

A date printed in bold may be a payment request, a court hearing, or a deadline to answer a lawsuit. Those dates have different legal consequences. Identify the proceeding and service method before calculating when to respond.

When Does the Response Period Begin?

In an ordinary state civil lawsuit, personal service generally gives a defendant 30 days to respond. Substituted service generally allows 40 days after mailing. Eviction and other special proceedings follow different rules.

  • Identify who received the papers and when.
  • Check for personal service or substituted service.
  • Check whether a weekend or court holiday changes the last day.

What If You Cannot Understand the Notice?

Not understanding English does not itself pause a court deadline. An attorney can identify the response required before translating every allegation. Settlement talks do not automatically extend filing time.

  • Bring the complete English version, not just excerpts.
  • Explain how and when the papers were delivered.
  • Ask whether a valid extension is available.

3. What Can Bilingual Legal Review Clarify before Signing?

An accurate translation may still leave a difficult question: what happens if you sign? A settlement or contract can impose payment duties, release claims, or change how disputes are resolved. Review those effects before deciding.

Which Clauses Deserve Closer Review?

Words such as “release,” “waiver,” and “binding arbitration” can affect more than the payment shown on the first page. Ask how these terms apply to your circumstances.

  • Identify duties that begin when you sign.
  • Check release language and dispute procedures.
  • Compare spoken promises with written terms.

Related issues appear in contract drafting and review.

What If the Korean Explanation Differs?

A familiar Korean phrase may not capture the legal effect of an English clause. Ask whether the agreement identifies a controlling version and how any conflicting wording would be handled.

  • Find any provision about the controlling language.
  • Compare dates, amounts, names, and defined terms.
  • Request written clarification of disputed wording.

4. What Should Your First Legal Consultation Resolve?

You should not have to master legal vocabulary before meeting an attorney. Explain what arrived, what happened beforehand, and what you fear might happen next. Start with decisions tied to a filing deadline or signature.

Which Facts Should You Share First?

A short timeline gives the attorney a reliable starting point. Include any payment, reply, or signature already made, even if you now question that decision.

  • Arrange documents and messages chronologically.
  • Note payments, conversations, and earlier replies.
  • Point out hearing dates and requested signatures.

What Questions Should You Ask?

Ask which demands are legally enforceable and which are merely proposed. Once representation begins, Rule 1.4 of the Rules of Professional Conduct requires explanations that support informed client decisions.

  • What must I do, and by when?
  • What could change if I sign or decline?
  • Which records or decisions are needed next?

For disputed contractual duties, see breach of contract.

5. Frequently Asked Questions

Can a family member interpret during my consultation?

Ask who will interpret and whether the attorney speaks Korean directly. A family member may not be suitable for sensitive discussions or technical legal terms.

Can I request a Korean interpreter for a court hearing?

Court interpreters are provided without charge when available. Request one as early as possible and follow the court's procedure; availability may vary, and an interpreter cannot give legal advice.

Are my questions confidential before I hire an attorney?

Rule 1.18 limits the use and disclosure of protected information learned during qualifying prospective-client consultations. It does not make every unsolicited message confidential, so ask before sending sensitive records.
