Ca Theft Attorney for Defense against State Criminal Charges

A CA theft attorney reviews the charged offense, qualifying prior convictions, and evidence to build a defense in state court.

A theft allegation involving $950 or less can still carry felony exposure when qualifying prior convictions apply. Prosecutors may also aggregate property values from multiple incidents. The charging document, prior judgments, and incident records help determine which rules apply and what evidence the defense should challenge.

Contents

1. Which Theft Charge Are You Facing?

The first question is which offense the charging document actually alleges. In California superior court, a defense attorney checks the statute, incident dates, and misdemeanor or felony designation before evaluating the available responses.

Petty Theft, Grand Theft, and Shoplifting

For ordinary property theft, property worth $950 or less generally falls within petty theft, while value above $950 generally supports grand theft. Exceptions and qualifying prior convictions can change the analysis. Many grand theft offenses can be prosecuted as misdemeanors or felonies.

Penal Code §459.5 defines shoplifting as entering a commercial establishment during its regular business hours with intent to commit larceny involving property worth no more than $950. A completed taking is not required. The entry sequence and checkout records may help distinguish intent at entry from conduct that arose later.

Related Offenses Require Separate Analysis

Embezzlement concerns fraudulent appropriation of entrusted property. Receiving stolen property requires analysis of knowing receipt, possession, or other conduct covered by the charged provision. Robbery and burglary have separate elements.

A federal statute on the charging papers requires separate analysis of federal theft charges. State classifications do not determine federal exposure.

2. What Can Increase Your Criminal Exposure?

Qualifying prior convictions and multiple incidents can change the charging level and possible sentence. An attorney checks each asserted basis rather than accepting a general description such as “repeat offender.”

Qualifying Prior Convictions

Penal Code §666.1 can create felony exposure for petty theft or shoplifting when the person has two or more specified prior convictions. An arrest is not a conviction. An attorney checks the offense, judgment, and identity records for each alleged prior, including any orders affecting its status.

The provision also requires judicial review before release following an arrest under that section. That review addresses public safety and the likelihood of returning to court.

Multiple Incidents and Aggregated Value

Penal Code §490.3 permits aggregation of property values from multiple theft or shoplifting acts into a single count or charge. It does not require the same common-plan showing associated with certain other aggregation rules.

Defense review tests whether each incident is attributable to the accused, whether the figures have evidentiary support, and whether items were counted twice. Incident dates also matter because the applicable law must be checked against when the conduct allegedly occurred.

3. How Is a Theft Defense Built?

The prosecution must prove the charged offense beyond a reasonable doubt. A defense lawyer connects disputed elements to the evidence, then assesses factual defenses, admissibility challenges, negotiation, and trial.

Intent, Permission, and Identification Evidence

For theft by larceny, prosecutors must establish the required intent when the property was taken. That intent includes permanent deprivation or deprivation for so long that the owner loses a major portion of its value or enjoyment. Messages or authorization records may support a genuine permission or ownership dispute.

These records address different parts of the allegation:

RecordDefense Question
Full surveillance sequenceDoes it reliably identify the person and show the relevant conduct?
Receipts and payment logsWas payment completed, attempted, reversed, or attributed incorrectly?
Messages and authorization recordsWhat permission existed, and when?
Itemized property recordsWhich items and values belong to each alleged incident?

Representation from Investigation through Trial

During an investigation, an attorney can review interview requests, communicate with investigators, and seek preservation of third-party records. After filing, representation includes discovery review, appropriate motions, negotiations, and hearing or trial preparation. Diversion or misdemeanor reduction may warrant review, but availability depends on the charge, eligibility rules, and court decisions.

At arraignment, the court addresses the charges, plea, and custody or release issues. Felony prosecutions by complaint generally involve a preliminary hearing unless waived. An indictment follows a different route. Any proposed resolution should be reviewed for sentencing terms, restitution, and consequences for immigration status or professional licensing.

4. Practical Pitfalls before Your Next Court Date

Statements, lost records, or missed hearings can complicate a defense. Keep the documents you receive and follow court notices and release orders while an attorney investigates.

Statements and Contact with Witnesses

Avoid trying to persuade store staff or witnesses to change their accounts. Share relevant names and communications with your attorney instead.

Returning property or making a payment does not itself dismiss a prosecution. A retailer's civil demand is separate from the criminal case, and its terms should be reviewed before treating payment as a resolution.

Preserve Originals and Confirm Required Appearances

Early evidence preservation helps identify recordings at risk of routine deletion. Keep complete messages, receipts, and original files without editing or deleting unfavorable material. Identify who holds store footage so an attorney can request preservation.

Check the court, case number, hearing date, and release conditions on your papers. An absent online docket entry does not excuse a scheduled appearance.

5. Frequently Asked Questions

Living elsewhere or needing appointed representation can affect preparation for the next hearing. Confirm arrangements with the court or your attorney before assuming someone will appear for you.

Can an Attorney Appear If I Now Live Outside California?

An attorney may appear for a defendant at some misdemeanor proceedings, subject to statutory requirements and court orders. Felony attendance requirements differ. Moving away does not excuse attendance, so confirm permission before making travel decisions.

Can I Request a Public Defender for a Theft Charge?

If you cannot afford representation, ask the court about appointed representation. For a qualifying misdemeanor or felony case, the court can appoint an attorney, often a public defender. Tell the judge at arraignment that you cannot afford an attorney.

6. Discuss Your Theft Charge with an Attorney

Bring the charging papers, next hearing notice, release conditions, prior-case records, and available transaction evidence to a consultation. A CA theft attorney can assess the charged provisions, identify missing records, and explain the next procedural step. For retail allegations, shoplifting defense may include reviewing loss-prevention reports.
