New York Workers' Compensation Laws: Employee Benefits

Workers' compensation pays regardless of fault. It also bars you from suing your employer.

The Board decides disputes; it does not guarantee payment. Carriers contest claims — whether the injury is work-related, whether treatment is necessary, what degree of disability applies — and the Board resolves those disputes. Most contested claims involve a denial of something, not an absence of a system.

What compensation does not cover is pain and suffering. Benefits reach medical treatment and a portion of lost wages. Nothing else.

Which is why the third party matters. Exclusivity protects the employer. It does not protect a general contractor, a property owner, an equipment manufacturer, or a driver — and a claim against any of them allows the full range of damages compensation excludes.

Construction injuries in particular. Labor Law § 240(1) imposes absolute liability on owners and general contractors for gravity-related injuries, with no comparative negligence defense. Recovery in those cases regularly exceeds what the compensation claim provides.

Notice within thirty days, claim within two years. Both run from the injury, or for occupational disease, from when the worker knew or should have known the condition was work-related.

New York Workers' Compensation Law covers nearly all full-time and part-time employees working within the state. Coverage applies regardless of fault, meaning an employee can receive benefits even if their own negligence contributed to the injury.



Covered Employment and Exclusions


Under New York law, most private and public sector employers must maintain workers' compensation insurance. Covered employment includes construction workers, office staff, healthcare personnel, and service industry employees. However, certain categories remain excluded or covered under separate statutory schemes:

Independent contractors who control their own work schedules and methods

Sole proprietors and business partners without employees

Domestic workers who work fewer than 40 hours per week for a single employer

Licensed real estate sales agents operating under written independent contractor agreements

Volunteers performing services for non-profit entities without remuneration



Definition of Work-Related Injuries and Diseases


To qualify for benefits, an injury or occupational illness must arise out of and in the course of employment. This standard encompasses sudden accidental injuries, repetitive strain injuries, and conditions caused by prolonged exposure to hazardous workplace environments. Injuries occurring during personal errands or off-duty activities generally fall outside coverage limits.



2. Financial and Medical Benefits Available to Claimants


The New York Workers' Compensation Board categorizes benefits into wage replacement payments and necessary medical treatment. These benefits help injured workers maintain financial stability while undergoing recovery and rehabilitation.



Wage Replacement Calculations and Statutory Caps


Disability benefits equal two-thirds of an employee's average weekly wage, subject to statutory maximum caps adjusted annually. The calculation uses the employee's gross earnings from the 52 weeks prior to the injury date. Partial disability benefits adjust based on the worker's reduced earning capacity following the accident.

Medical Care Coverage and Provider Authorization


Injured workers receive comprehensive medical care related directly to their workplace injury without copayments or deductibles. Treatment must come from health care providers authorized by the New York Workers' Compensation Board, except in emergency situations. Covered medical expenses include doctor visits, surgical procedures, prescription medications, physical therapy, and necessary diagnostic testing.



3. Procedural Steps for Filing a Claim


Claimants must strictly adhere to statutory deadlines and notification rules established by New York State law. Missing a procedural timeline can result in a claim denial or forfeiture of benefit payments.



Notice to Employer and Claim Submission


An injured worker must notify their employer in writing within 30 days of the accident or within 30 days of discovering an occupational disease. Following written notice, the claimant must file Form C-3 (Employee's Claim) with the Workers' Compensation Board within two years of the injury date. The employer then files Form C-2F (Employer's Report of Work-Related Injury) with its insurance carrier.



Resolving Claim Disputes before the Board


When an insurance carrier controverts a claim, the Board schedules a pre-hearing conference before a Workers' Compensation Law Judge. The judge conducts hearings, reviews medical testimony, evaluates wage evidence, and issues binding determinations. Either party may appeal the judge's decision to a three-member Board panel within 30 days.

An office employee develops carpal tunnel syndrome from years of continuous typing. The worker provides written notification to the supervisor, visits a Board-authorized physician, and files Form C-3 with the Board. The insurance carrier disputes the claim, arguing the condition resulted from personal activities. A judge reviews the treating physician's medical reports, finds the injury work-related, and awards wage replacement benefits and medical coverage.
