Eb5 Lawyer Guide to Tracing Funds Across Multiple Countries

EB5 lawyer guidance explains how to document lawful investment funds transferred through multiple countries and accounts.

Proving where EB-5 funds originated is only part of the task. Records must also connect those funds to the investment through each relevant account, currency exchange, and cross-border transfer. Salary, sale, gift, or loan documents should align with the transaction history.

Contents

1. Separate Lawful Sources from the Movement of Funds

Federal EB-5 rules require evidence of lawful acquisition and transfer. In investment immigration, a property sale may explain the source, while bank records establish the subsequent route. Moving money through another country does not cure an unexplained origin.

Establish the Origin before Following the Transfers

The investor generally must establish eligibility by a preponderance of the evidence, meaning more likely than not. An account balance does not explain lawful origin. Identify the income, sale, gift, or borrowing behind the investment and connect it to the deposits.

Include Related Administrative Costs and Fees

The lawful-source requirement also covers investment-related administrative costs and fees. Identify who paid them and document their funding separately when it differs from the investment capital.

2. Connect Each Funding Source to Supporting Records

Employment and sale records explain how money arose, but may not establish what remained available. Connect each claimed source to the amount received and later transferred.

Salary and Accumulated Savings

Employment contracts, pay statements, tax records, and deposits can establish earnings. For accumulated savings, compare income with significant withdrawals over the relevant period. Gross compensation does not equal available savings. If income was tax-exempt or no return was required, explain why and provide supporting records.

Proceeds from Selling Property or a Business

A sale contract alone does not establish payment. Include ownership records, closing or settlement documents, and evidence that the buyer paid the proceeds. The property's original acquisition and its funding may also require explanation. For a business sale, distinguish money paid to the investor personally from money retained by a company.

Gifts and Borrowed Funds

A gift letter documents the stated arrangement, but the donor's lawful funding source and actual transfer also matter. For borrowing, the loan agreement should match the disbursement, parties, and repayment terms. Gifted or borrowed funds must involve a good-faith transaction rather than an attempt to bypass source restrictions. Required donor records, and lender records when the lender is not a bank, extend the inquiry beyond the investor's own account.

3. Build a Transaction History Across Countries and Accounts

Trace the funds chronologically to the investment account. A transaction schedule should identify account holders, dates, currencies, amounts, and supporting exhibits. Show separate branches where funding sources combine. The schedule explains the evidence without replacing it.

Match Outgoing Transfers with Incoming Credits

Review both sides of a transfer where records are available. A debit confirms money left an account, while the receiving statement helps establish its destination. Cross-reference transaction identifiers and explain different posting dates or account-name variations. Preserve the final wire confirmation and the investment recipient's acknowledgment of receipt.

Reconcile Currency Exchanges and Split Payments

A transfer may arrive in a different amount because of exchange rates or bank charges. Use transaction-specific conversion records rather than a current online rate. For split payments, show how the separate amounts combine and distinguish capital from fees. Where foreign exchange controls affect the route, review the applicable local requirements separately from federal EB-5 eligibility.

Explain Third-Party Accounts and Exchange Arrangements

Identify intermediaries and explain why they received or transferred funds. A relative's payment or an exchanger's dollar transfer should connect to the investor's corresponding transaction. Depending on the arrangement, additional evidence concerning the intermediary's funds may be necessary. Similar amounts and close dates alone may leave questions about ownership, lawful origin, or whether the transactions are connected.

4. Resolve Gaps and Conflicting Records before Filing

Missing records require evidence of unavailability and suitable substitutes. Conflicting explanations require reconciliation with the documents. Inadequate proof can lead to a request for evidence or denial, but a complex route alone does not establish ineligibility.

Address Mixed Accounts and Missing Historical Records

When an account contains several funding sources, identify the deposits relied upon and explain intervening withdrawals. An ending balance alone may not connect the investment to documented funds. If older records are unavailable, preserve requests and responses showing efforts to obtain them. Relevant secondary evidence may help, but a personal statement does not automatically replace missing required documents.

Prepare a Consistent Explanation and Complete Translations

Foreign-language documents submitted to USCIS require full English translations with the translator's certifications of accuracy, completeness, and competence. Explain naming differences and conflicting transaction descriptions without altering original records. For an EB5 lawyer's review, assemble the source records, transfer schedule, and unresolved questions before filing.
