How Can a California Manslaughter Lawyer Review Your Charges?

A California manslaughter lawyer can assess the charges, potential penalties, and evidence before your next court date.

An arrest record may list a suspected offense before prosecutors file formal charges. Once a criminal complaint is filed, check the Penal Code section and subsection listed for each count. A fatal crash can lead to a charge under § 192(c) or § 191.5, and what prosecutors must prove depends on the subsection charged.

Contents

1. Which Manslaughter Charge Has Been Filed?

Start with the latest charging document. The subsection tells you which offense prosecutors allege. Check for separate allegations too, since they can affect the possible sentence.

Find the Count and Code Section

A lawyer reviewing the criminal complaint starts with three details.

  • Count number. Each numbered count identifies a separate charge.
  • Code section and subsection. In a fatal crash case, check the full number. Section 192(c)(1) and § 191.5(a) both involve gross negligence, but § 191.5(a) also requires a qualifying DUI violation.
  • Separate allegations. Flag any claimed prior conviction or other allegation that could affect sentencing.

If prosecutors later file an amended complaint or an information, compare it with the earlier version. Check which counts changed and whether prosecutors added or removed any allegations.

Compare the Three Types of Manslaughter

Penal Code § 192 divides manslaughter into three types. The same outcome, a death, can lead to different charges depending on the conduct and circumstances.

  • Voluntary manslaughter, § 192(a). This can apply when legally sufficient provocation leads to a killing in the heat of passion. It can also apply when someone honestly but unreasonably believes deadly force is immediately necessary to prevent death or serious injury.
  • Involuntary manslaughter, § 192(b). A case can turn on whether criminally negligent conduct caused the death. Criminal negligence involves a serious risk of death or major injury that a reasonable person would have recognized. This subsection excludes acts committed while driving a vehicle.
  • Vehicular manslaughter, § 192(c). The required proof depends on the subsection. Section 191.5 separately covers fatal driving cases involving a qualifying DUI violation. Subsection (a) requires gross negligence. Subsection (b) applies when the conduct that caused the death involved negligence without rising to that level.

2. What Sentence Can Each Charge Carry?

The base term depends on the offense of conviction. The next step is to check for any prior conviction or separate allegation that could change the sentence.

Compare Base Terms by Code Section

Penal Code §§ 193 and 191.5 set the incarceration terms below. The table gives the statutory terms for each offense. The outcome in a specific case depends on the charges, findings, and applicable sentencing rules.

OffenseBase Incarceration Term
Voluntary manslaughter, § 192(a)3, 6, or 11 years in state prison
Involuntary manslaughter, § 192(b)2, 3, or 4 years under § 1170(h)
Vehicular manslaughter with gross negligence, § 192(c)(1)Up to 1 year in county jail or 2, 4, or 6 years in state prison
Vehicular manslaughter without gross negligence, § 192(c)(2)Up to 1 year in county jail
Vehicular manslaughter involving a crash knowingly caused for financial gain in connection with insurance fraud, § 192(c)(3)4, 6, or 10 years in state prison
Gross vehicular manslaughter while intoxicated, § 191.5(a)4, 6, or 10 years in state prison, subject to § 191.5(d)
Vehicular manslaughter while intoxicated without gross negligence, § 191.5(b)Up to 1 year in county jail or 16 months, 2 years, or 4 years under § 1170(h)

Check Prior Convictions and Probation Rules

Eleven years is the highest base term for voluntary manslaughter. A conviction under § 191.5(a) carries 15 years to life in state prison if a prior conviction meets § 191.5(d). A lawyer can compare the prior judgment with the offenses listed in that subsection.

For cases governed by the rule that took effect January 1, 2026, § 191.5(e) sets a probation term of three to five years if the court grants probation. Probation is a separate question from the base incarceration term.

3. What Evidence Can Change the Defense Assessment?

A California manslaughter lawyer can compare police reports with the records behind them. A report may give one account of a crash or confrontation. Original video, test results, and medical records can show where that account needs a closer look.

Rebuild the Timeline When Prosecutors Allege Murder

For heat of passion, the timing helps show what provoked the response and whether there was time to cool off. The law also asks how a person of average disposition might have reacted under the same circumstances.

For imperfect self-defense, the question is what the person actually believed about the immediate danger and the need to use deadly force. A recording that starts late may miss what the person saw or heard before acting.

Match the Records to What Prosecutors Must Prove

  • Fatal crash. Dashcam footage and vehicle data may show when the driver braked, where the vehicles were, or which impact came first.
  • Suspected impairment. A DUI evidence review can examine when a sample was taken, how it was handled, and what the result shows about the time of driving.
  • Disputed cause of death. Autopsy findings and treatment records can help determine whether the alleged conduct played a substantial role in the death. More than one event can contribute to a death.

4. What Should You Prepare before the Next Court Date?

If police request an interview before charges are filed, a lawyer can review the request and advise you before you respond. If a case is already in court, check the hearing notice for the date and type of hearing.

Know What the Next Hearing Will Decide

At arraignment, the court advises the defendant of the charges and takes a plea. If the case proceeds to a felony preliminary hearing, a judge decides whether there is enough evidence for it to move forward. The defense can question prosecution witnesses at that hearing.

Keep Original Records for a Case Review

Save full message threads and original video files. Keep the paperwork you receive and note who may have other recordings. A lawyer reviewing the criminal evidence can use that information to identify records that may need to be preserved promptly.

To request a case review with a California manslaughter lawyer, bring the latest charging document, the hearing notice, and any police paperwork you have. The review can identify which allegations need attention before the next hearing and which records may help assess them.
