Criminal Defense Attorney on Long Island Explains Early Court Steps

Практика:Criminal Law

Автор : Donghoo Sohn, Esq.

A criminal defense attorney on Long Island can review arrest papers or an appearance ticket to identify the court and first hearing date.

Nassau and Suffolk have different local court structures, while federal prosecutions follow separate procedures. Check the case number, charges, and release conditions; preserve relevant messages or video; and seek legal advice before discussing the allegations. Misdemeanor, felony, and federal cases may follow different paths.

1. The First Notice Establishes the Next Court Obligation

A police interview, arrest, and appearance ticket create different obligations. Check whether a court date is assigned and a charging document has been filed.

Arrest and Initial Arraignment

After a custodial arrest, authorities generally bring the person before a judge without unnecessary delay. Arraignment addresses charges, counsel, and release, not guilt. Police allegations may differ from filed charges.

CPL § 170.10 governs arraignment on misdemeanor complaints and other specified instruments. Felony complaints follow § 180.10, including the right to a prompt preliminary hearing that the defendant may waive. Keep the arrest papers and any instructions received.

Appearance Tickets and the Return Date

An appearance ticket instructs the recipient to attend a designated local criminal court. CPL § 150.20 generally requires tickets for eligible warrantless arrests, subject to exceptions. Section 150.40 generally sets a return date within 20 days, with exceptions for later court sessions and approved diversion.

A ticket does not establish guilt or replace a filed accusatory instrument. Check the court date even if police released you. For issues specific to lesser charges, see misdemeanor criminal defense.

2. The County and Charge Determine the Correct Court

State criminal procedure applies across the counties, but the courts differ. The alleged offense and its location determine the first court and possible felony transfer.

Nassau and Suffolk Local Courts

Nassau County District Court handles misdemeanors, violations, and preliminary felony matters. Glen Cove and Long Beach also have City Courts. In western Suffolk, District Court serves Babylon, Brookhaven, Huntington, Islip, and Smithtown; local Town and Village Justice Courts serve eastern Suffolk.

Local courts can arraign felony defendants, but felony trials generally proceed in County Court. Follow the latest notice because the hearing location may change.

Federal Cases in the Eastern District

Federal criminal cases follow federal law and the Federal Rules of Criminal Procedure, rather than state arraignment and discovery schedules. Federal Rule 5 governs initial appearances following an arrest or summons.

Nassau and Suffolk fall within the Eastern District of New York. Under its division-of-business rules, cases involving crimes allegedly committed wholly or substantially in these counties are generally assigned to Central Islip, subject to reassignment. A federal complaint, indictment, or summons requires separate procedural review. See federal criminal defense for later stages.

3. The First Appearance Addresses Rights and Release

Arraignment identifies pending charges and sets further obligations; it is not a trial. Confirm counsel, release conditions, and any order of protection.

Counsel and Investigative Statements

CPL §§ 170.10 and 180.10 recognize the right to counsel at the relevant arraignment and subsequent stages. Eligible defendants unable to pay may receive court-assigned counsel. Tell counsel about previous interviews, signed statements, consent searches, and police requests for devices.

The Fifth Amendment protects against compelled self-incrimination. Miranda warnings concern custodial interrogation, not every police conversation. Seek legal advice before a voluntary interview; subpoenas and court orders require separate attention.

Bail, Release, and Protective Orders

Under CPL § 530.20, courts generally order recognizance or nonmonetary release for charges that are not bail-eligible. Qualifying offenses permit other options, including bail and, for certain felonies, detention. Obtain the written order and clarify travel, reporting, and contact restrictions.

Release does not end the case. Missing court or violating an order can create further legal problems. The separate arraignment and bail hearing resource addresses release decisions in greater depth.

4. Court Records and Evidence Need Different Handling

Charging papers, prosecution discovery, and private evidence require different handling. Distinguish records provided in court from materials to be disclosed or preserved.

Charging Papers and Case Numbers

At an in-person arraignment, CPL §§ 170.10 and 180.10 require the court to explain the charges and furnish the accusatory instrument. Compare it with the arrest paperwork. Record the docket number, court instructions, and next date.

WebCrims displays future appearances in covered state cases, not warrants, sealed cases, or closed matters. If no listing appears, confirm the status with the clerk or counsel. Other records may require separate requests.

Preserving Evidence and Reviewing Discovery

Preserve original texts, emails, photographs, receipts, and relevant recordings without editing them. Identify third-party surveillance footage that may be overwritten and discuss preservation requests with counsel. Do not delete files or seek to influence witnesses. Additional evidence preservation considerations may apply.

In covered state cases, CPL §§ 245.10 and 245.20 generally require initial prosecution discovery within 20 calendar days after arraignment for defendants in custody, or 35 days for those not in custody. Exclusions, extensions, and protective orders can affect disclosure. These deadlines do not guarantee immediate access to every record.

5. Upcoming Dates and Procedural Deadlines Must Be Checked

The next event may be a preliminary hearing, discovery conference, or court appearance. Check the latest notice; the original ticket date may no longer control.

Felony Complaint Custody Limits

Under CPL § 180.80, a defendant held on a pending felony complaint may apply for release after more than 120 hours without disposition of the complaint or commencement of a hearing. The period is 144 hours if custody includes a weekend or legal holiday.

Exceptions include defendant-caused delays, specified grand jury actions, and good cause shown by prosecutors. The provision concerns release on that complaint, not dismissal of charges or a federal prosecution deadline.

Information to Confirm before Returning

Before court, check the charging document, courthouse, hearing time, and active restrictions. Ask what discovery remains outstanding, whether a motion or hearing deadline applies, and whether a felony case has moved to County Court. Suffolk District Court does not grant adjournments through a telephone request alone.

A criminal defense attorney on Long Island can assess these questions against the actual court file. The most useful preparation is a verified appearance date, current charging papers, and preserved evidence.
