What Tax Problem Should a Tax Lawyer in Nanuet Review First?

Практика:Others

Автор : Donghoo Sohn, Esq.

A tax lawyer in Nanuet may first determine whether the issue involves the IRS, New York State, a filing error, an audit, collection, or a formal tax protest.

The right response depends on the agency, tax type, tax year, notice, and procedural stage. A filing error may call for an amended return, while an audit, assessment, or collection matter follows a different path. The first step is to identify who issued the document, what period it covers, and whether a response, protest, or court deadline is running.

1. Identify Whether the Notice Is Federal or New York State

The agency named on the notice determines which rules apply. IRS matters follow federal tax law and federal administrative procedures. Notices from the New York State Department of Taxation and Finance follow New York law and state protest procedures.

Nanuet does not have a separate system for federal or New York State income tax disputes. The location identifies where the taxpayer or business is based, but it does not change the ordinary federal or state rules. A broader tax law and administration review may be useful when several tax periods or taxing authorities are involved.

Read the Notice before Choosing a Response

A tax notice does not necessarily mean an audit has begun, an assessment is final, or a court filing is required. It may request records, propose an adjustment, state an amount due, or provide formal protest rights.

The notice number, tax year, mailing date, and stated deadline should be read together. Calling an agency or sending records should not be assumed to preserve a separate protest or court deadline.

2. Separate a Filing Error from an Audit or Assessment

An error on a filed return does not automatically create a tax controversy. Before a formal dispute develops, correction may be possible through an amended return. The analysis changes once the IRS or New York Tax Department begins examining an item or issues an assessment or determination.

Useful records usually include the complete notice, the federal and New York returns for the affected year, relevant W-2s, 1099s, K-1s, payroll or business records, earlier correspondence, payment records, and any amended returns.

An IRS examination should focus on the specific items under review. An IRS audit defense analysis may address requested records, proposed adjustments, and available administrative procedures.

Federal Changes May Require a New York Amended Return

Federal and New York filings are separate, but a federal change can create a New York reporting obligation. For personal income tax, a taxpayer who files an amended federal income tax return generally must file the corresponding New York amended return within 90 days. A qualifying final IRS determination generally must also be reported within 90 days.

New York corporate rules require separate attention. Under the Article 9-A reporting rules, an amended federal return or final federal determination generally triggers a 90-day state reporting period, while a taxpayer filing a combined report may have a 120-day period in circumstances covered by the statute.

An IRS matter can therefore end while a New York reporting requirement remains. Businesses with state-specific or multistate liabilities may also need a separate state and local tax analysis.

3. Determine Whether the Dispute Concerns Liability or Collection

A taxpayer disputing the amount of tax is in a different procedural position from someone who accepts the liability but cannot pay it.

Before liability becomes final, the dispute may concern reported income, deductions, credits, business expenses, classification, or another proposed adjustment. After assessment, the focus may shift to payment arrangements and collection procedures.

A Notice of Deficiency Starts a Tax Court Filing Period

A statutory IRS Notice of Deficiency is different from an ordinary IRS letter. A petition in a deficiency case generally must be filed with the U.S. Tax Court within 90 days after the notice is mailed. The period is generally 150 days if the notice is addressed to a person outside the United States.

The notice may also state the last date for filing a timely petition. These rules should not be applied to every IRS notice because other administrative and collection proceedings have different deadlines.

If the liability is no longer disputed but the taxpayer cannot pay the balance, a tax debt resolution review may instead focus on the assessed balance, collection status, financial information, and available collection alternatives.

4. Follow the Protest Rights in a New York Tax Notice

When a New York Tax Department notice expressly provides protest rights, a taxpayer may generally request a conciliation conference through the Bureau of Conciliation and Mediation Services or file a petition for a hearing with the Division of Tax Appeals.

Preserve the Deadline before Continuing Informal Discussions

The filing deadline shown on the notice is critical. Additional documents, telephone discussions, or a request that the Department reconsider its position should not be assumed to extend a formal protest deadline.

Not every Tax Department document carries the same protest rights. Requests for Information and some adjustments may require a different response. New York also identifies matters in which ordinary protest or appeal rights are unavailable, including certain mathematical or clerical errors, changes made by the IRS to a federal return, and failure to pay tax that the taxpayer reported as due.

The document itself should therefore control the procedural analysis rather than a general label such as “New York tax dispute.”

5. Match the Response to the Current Stage of the Tax Matter

A tax review should identify the government authority, tax type, affected year, current procedural stage, and any deadline stated in the controlling document. Those facts usually determine whether the next step involves an amended return, audit response, formal protest, Tax Court petition, or collection issue.

A tax lawyer can also review the notices, returns, prior agency correspondence, and procedural history to determine whether a federal matter has created a separate New York filing obligation or whether a deadline must be preserved before the underlying dispute continues.
