Trademark Enforcement Options for Infringement and Disputes

Автор : Donghoo Sohn, Esq.

Trademark enforcement helps owners address suspected infringement through cease and desist letters, online reports, TTAB proceedings, or litigation.

Trademark enforcement starts with ownership, disputed use, and likely confusion. New York owners may seek removal, challenge registrations before the TTAB, or pursue court relief.

1. When Trademark Enforcement Is Legally Justified

A similar name alone does not establish infringement. The owner needs enforceable rights and evidence of likely confusion about commercial source.

Trademark Rights and Likelihood of Confusion

Lanham Act § 1114 addresses registered-mark infringement; § 1125(a) may protect unregistered marks. Second Circuit courts use Polaroid factors, including:

  • Mark strength and similarity.
  • Proximity of the goods or services.
  • Evidence of actual confusion.
  • Intent and purchaser sophistication.
  • Other relevant market circumstances.

No factor controls. Earlier use may establish geographically limited common law rights. Reviewing intellectual property rights may help clarify priority before a dispute escalates.

Evidence Needed to Establish Infringement

Preserve dated listings, packaging, advertising, and seller details. Registration records, invoices, and licenses may support priority; mistaken purchases can support confusion, but are not always required.

2. How Trademark Owners Can Stop Infringing Use

Letters may resolve limited disputes; repeated counterfeits or sales may require platform action or an injunction.

Trademark Infringement Cease and Desist Letters

A demand letter identifies the mark, challenged use, legal basis, requested changes, and deadline. It is not a court order; the recipient may assert prior use or fair use. A trademark coexistence agreement can define permitted products, territories, or branding.

How to Stop Counterfeit Products Online

Marketplace reports require listing details and supporting records. Save screenshots and complaint confirmations: platform removal does not establish infringement liability.

Counterfeits differ from unauthorized resale of genuine goods. The first-sale doctrine generally permits genuine resale; material differences or inadequate quality controls may alter the result. Repeat listings may warrant legal action.

3. Ttab Proceedings Versus Trademark Infringement Lawsuits

The TTAB decides federal registration disputes, not infringement. Only a court can order an injunction against sales.

Ttab Opposition and Cancellation Proceedings

Opposition is generally due 30 days after publication unless extended. Cancellation challenges an existing registration; under 15 U.S.C. § 1064, available grounds narrow after five years, with specified exceptions.

The TTAB cancellation proceeding timeline depends on discovery, motions, and testimony. Cancellation does not itself prohibit commercial use.

Courts may also resolve registration issues under 15 U.S.C. § 1119.

4. Trademark Enforcement Remedies under Federal and New York Law

Federal and New York remedies have distinct elements and proof requirements. Trademark owners should identify the applicable legal claims and supporting evidence before seeking an injunction or monetary recovery.

Federal Injunctions and Monetary Recovery

Under § 1116, injunctions remain subject to equity. Findings of infringement, or likely success for preliminary relief, trigger a rebuttable presumption of irreparable harm.

Section 1117 allows qualifying profits, damages, and costs; attorney fees require an exceptional case. Section 1117(c) statutory damages apply to qualifying counterfeits, not ordinary infringement. Continued sales may warrant civil litigation.

New York Trademark Infringement and Dilution

New York GBL § 360-k covers state-registered marks. Profits or damages under that section require intent to cause confusion, mistake, or deception. Section 360-m provides injunctions and qualifying monetary remedies.

Section 360-l permits injunctions for likely reputational injury or dilution through blurring or tarnishment without competition or confusion. Distinctiveness and legally significant harm still matter; national fame is not required.

5. Frequently Asked Questions

Can You Enforce a Trademark Without Federal Registration?

Yes. Qualifying use may create common law rights; § 1125(a) may protect unregistered marks if the owner proves protectable rights, priority, and the relevant infringement elements.

Can You Sue Without Proof of Actual Confusion?

Yes. Courts consider likely confusion based on the marks, goods, purchasers, and context; actual mistaken purchases are not essential.

Is a Cease and Desist Letter Required Before Suing?

No general federal trademark rule requires one. A letter may resolve a dispute, but urgent harm or evidence risks may justify court action.

6. When to Seek Legal Review for Trademark Enforcement

For repeat counterfeits, approaching opposition deadlines, or ongoing sales, collect registration and first-use records, listings, licenses, and correspondence. An attorney can assess a letter, TTAB filing, or lawsuit. Overlapping trademark and copyright enforcement may require separate legal claims.
