It is distinct from technical wallet access recovery. The process involves civil litigation, provisional court relief, regulatory cooperation, and exchange-level discovery rather than software-based credential retrieval.



Can Stolen Cryptocurrency Be Recovered?


Stolen cryptocurrency may be recoverable when transactions can be traced to identifiable people, custodial accounts, or reachable assets. Recovery becomes less likely when funds remain in anonymous self-hosted wallets, pass through mixing services, or move to jurisdictions with limited legal cooperation. Blockchain tracing alone does not guarantee that a court can reach the property.



How Is Blockchain Forensics Used in Asset Recovery?


Blockchain forensics analyzes on-chain transaction data to trace cryptocurrency from a known source wallet through subsequent addresses. The analysis may indicate that assets reached addresses attributed to an exchange, custodian, mixing service, or other platform. Attribution alone does not establish current custody, account ownership, or the identity of the person controlling the address.

When used in litigation, a forensic report may need to be authenticated and supported by a reliable methodology and qualified testimony. Additional discovery or law enforcement action may be required to connect the transaction path to a responsible person, account, or entity.



What Types of Crypto Fraud Lead to Recovery Actions?


Legal recovery actions arise across several categories of cryptocurrency fraud, including investment and yield fraud, romance scams involving fabricated trading platforms, exchange hacks and insider theft, rug pulls, and Ponzi schemes structured around digital assets. The legal strategy in each category differs.

Investment fraud may involve securities claims. Hacking cases may implicate computer fraud statutes. Romance scam recovery often depends on identifying the domestic financial layer where proceeds were converted.

What Provisional Remedies May Be Available?

A federal court generally may not freeze unrelated assets solely to secure a future money judgment. Ex parte relief requires strict compliance with Rule 65, including proof of immediate irreparable harm and applicable notice and security requirements.

In New York, possible remedies include attachment under CPLR 6201, an injunction under CPLR 6301, or limited pre-action disclosure under CPLR 3102(c), each subject to separate jurisdictional and evidentiary requirements.



How Can Exchange Records Be Obtained?


In pending U.S. .itigation, a party may serve subpoenas seeking account records from a domestic exchange under the applicable procedural rules. Production remains subject to jurisdiction, proper service, objections, privacy requirements, and applicable law. A subpoena may seek KYC records, transaction history, account identifiers, and balance information.

For offshore exchanges, civil options may include letters rogatory, Hague Evidence Convention procedures where applicable, discovery from U.S.-based related entities, or proceedings initiated with foreign counsel under local law. MLAT requests are government-to-government procedures available to criminal investigators and prosecutors, not to private counsel in civil proceedings.



What Civil Claims May Be Available?


Potential civil claims may include fraud, conversion where recognized, unjust enrichment, and claims against parties alleged to have knowingly assisted the scheme. Civil RICO under 18 U.S.C. §§1961-1968 is available only when the plaintiff can establish the required enterprise, pattern, predicate acts, standing, and causation.

Wire fraud under 18 U.S.C. §1343 may qualify as a RICO predicate but does not independently create a private civil claim. A civil claim under the Computer Fraud and Abuse Act is subject to 18 U.S.C. §1030(g). Where court-ordered relief is available, it may help preserve identifiable assets while the underlying civil litigation proceeds.



3. What Are the Obstacles to Crypto Asset Recovery?


Understanding the practical and legal limits of recovery is as important as knowing the available tools. Even when transactions can be traced, recovery still depends on identifying a legally reachable person, account, custodian, or asset.



When Is Recovery Difficult or Unlikely?


Recovery becomes substantially more difficult when funds have been transferred to non-custodial wallets, converted through mixing layers, withdrawn as cash, or held in jurisdictions without effective legal cooperation. The longer the interval before legal action, the more likely assets have been dispersed.

No attorney or recovery service can guarantee the return of cryptocurrency. Demands for cryptocurrency to unlock supposedly recovered assets are a strong warning sign, particularly when combined with guaranteed recovery percentages or unverifiable credentials. The FBI has documented recovery scams as a category of secondary fraud targeting prior cryptocurrency victims.



4. What Role Do Federal Regulators Play?


Victims may report cryptocurrency fraud to IC3 and, depending on the conduct, to the FTC, SEC, or CFTC. A complete report may provide information useful to the agency, but filing does not guarantee an investigation, asset seizure, forfeiture, or recovery.

The SEC may bring securities enforcement actions involving digital securities or crypto transactions that constitute investment contracts or otherwise fall within the federal securities laws. The CFTC regulates digital asset derivatives and has enforcement authority over fraud and manipulation involving digital asset commodities. The DOJ and FBI investigate and prosecute cyber fraud involving cryptocurrency under wire fraud, money laundering, and computer fraud statutes.

In June 2025, the DOJ filed a civil forfeiture complaint against more than $225.3 million in cryptocurrency allegedly connected to investment fraud and money laundering, although filing a complaint does not establish final forfeiture or victim repayment. If a criminal case follows, counsel may submit victim-loss documentation, but prosecutors and the court control forfeiture and restitution.



5. How Can an Attorney Help with Crypto Asset Recovery?


Counsel can coordinate blockchain analysis, evaluate civil claims, seek available provisional relief, and pursue exchange discovery. Early assessment should focus on transaction records, exchange jurisdiction, obtainable identity information, and reachable assets because provisional remedies depend on assets remaining identifiable when relief is sought. Counsel experienced in cryptocurrency and digital asset law can also evaluate whether regulatory reporting, parallel law enforcement engagement, or cross-border coordination is warranted given the specific facts.
