Before Candidate or Committee Registration Is Triggered


An individual generally becomes a federal candidate after raising or spending more than $5,000, subject to testing-the-waters rules. Form 2 is due within 15 days and designates a principal campaign committee. A new principal committee generally files Form 1 within 10 days.

Before Accepting a Questionable Contribution


For the 2025–2026 cycle, an individual may generally give up to $3,500 per election to a federal candidate committee. Before Sharing Strategy with a Candidate or Campaign


For covered communications, 11 C.F.R. § 109.21 uses payment, content, and conduct standards. All three prongs must be met. The payment may then count as an in-kind contribution, bringing limits, source restrictions, and reporting duties into play.

Before an Independent Expenditure Starts the Reporting Clock


An independent expenditure expressly advocates the election or defeat of a clearly identified federal candidate and is not coordinated with a candidate, campaign, or political party. Reporting can be due quickly after public dissemination.

  • $10,000 or more in aggregate generally triggers a 48-hour report through the 20th day before an election.
  • $1,000 or more after that point, but more than 24 hours before the election, generally triggers a 24-hour report.


When a Political Party Is Involved after the 2026 Supreme Court Ruling


On June 30, 2026, the U.S. Supreme Court held in National Republican Senatorial Committee v. FEC that FECA's political-party coordinated-expenditure limits violate the First Amendment. The ruling concerns 52 U.S.C. § 30116(d), not a blanket exemption from other campaign finance rules.

  • Check current FEC material because some party guidance still reflects the former limits.


3. When Should a Campaign Finance Lawyer Step in after a Problem Appears?


Once a payment, filing, or communication has occurred, reconstruct the facts before choosing a response. Bank records, donor data, contracts, messages, and filed reports often determine which correction or agency process applies.



When a Contribution or Report Needs Correction


Excess contributions, prohibited sources, attribution problems, and incomplete reports require different responses. Depending on the facts and timing, federal rules may allow a refund, redesignation, reattribution, or amended report.

  • Reconcile bank activity with the report and document the correction.


When an Fec Complaint or Related Inquiry Arrives


The FEC generally notifies a respondent after receiving a proper complaint. The respondent has 15 days after notification to submit a written response. A reason-to-believe finding may lead to investigation or conciliation, but it is not a final violation finding.

Do federal campaign finance rules apply before someone formally announces a candidacy?

They can. Testing-the-waters activity follows special rules. If the individual later becomes a candidate, certain funds raised or spent while exploring the race count toward the $5,000 threshold.


Can a corporation fund an independent ad about a federal candidate?

Yes. Corporate independent expenditures are permitted, but they must remain independent and may trigger reporting and disclaimer duties. Foreign-national rules still apply.


Can a Super PAC give money directly to a federal candidate?

No. A Super PAC may accept unlimited contributions from permissible sources, including corporations and labor organizations, but it may not make contributions to federal candidates.


Can an organization still request an FEC advisory opinion without a quorum?

A qualifying request may be submitted, but an advisory opinion requires approval by at least four commissioners. With two sitting commissioners as of September 2026, the Commission cannot approve an opinion unless its membership changes.
