What Should You Check First for NYC Criminal Defense?

业务领域:Criminal Law

NYC criminal defense begins with checking the alleged conduct, charging papers, court, and next required appearance.

Start with the statute listed in your papers and the facts supporting the accusation. An appearance ticket is not itself a charging document, and a police interview request may precede any filed case. Your current stage determines which procedures apply and what needs attention.

Contents

1. What Do Your Charging Papers Actually Allege?

Read the factual allegations alongside the statutory citation. The narrative explains what prosecutors claim you did and whose account supports that claim. An initial criminal defense review connects those allegations to the offense’s elements and identifies records that could test them.

Identify the Document and Its Legal Function

A Desk Appearance Ticket directs you to appear in court. A misdemeanor complaint, information, felony complaint, or indictment serves a different function. Obtain the filed charging document rather than relying on the ticket alone.

Under CPL § 100.40, an information generally requires nonhearsay allegations establishing, if true, each element and your commission of the offense. Misdemeanor and felony complaints require reasonable cause but do not carry that same nonhearsay requirement. These filing standards differ from proof beyond a reasonable doubt at trial.

Match the Facts to the Required Elements

Identify the required mental state, conduct, and circumstances. Depending on the charge, permission, ownership, injury, value, or control over property may matter. Calling an item “yours” does not explain how prosecutors intend to prove possession.

A missing allegation and an allegation you dispute raise different issues. One concerns the document’s legal sufficiency; the other may require examining evidence. Neither automatically establishes that the case must be dismissed.

2. The Court and Case Stage Determine the Next Step

Use the court name, prosecuting office, and latest order to identify the applicable procedure. Borough differences matter for the responsible District Attorney’s Office, courthouse, and calendar. They do not create separate rules for criminal liability under state law.

Distinguish State and Federal Proceedings

NYC Criminal Court handles misdemeanors and lesser offenses, plus arraignments and preliminary proceedings in felony cases. Felony prosecutions generally proceed in Supreme Court Criminal Term after indictment or another authorized charging route. Despite its name, Supreme Court is a trial court.

Federal prosecutions follow federal law and procedure in U.S. District Court. Manhattan and the Bronx lie within the Southern District of New York; Brooklyn, Queens, and Staten Island lie within the Eastern District. Actual venue depends on the offense and relevant conduct, not simply your address.

Check the charging document and prosecutor’s identity before applying state procedures to a federal criminal case. The location of an interview alone does not identify the governing system.

Confirm the Purpose of the Next Appearance

At arraignment, the court addresses the charges, representation, and release or custody. Eligible defendants who cannot afford an attorney may receive appointed representation. Arraignment is not ordinarily a contested trial deciding guilt.

Later dates may concern discovery, motions, or hearings. Keep court notices and release orders together, and confirm appearance requirements with your attorney or the court clerk. A missing online listing does not cancel a scheduled appearance.

3. Which Rights Matter When Investigators Contact You?

Identify the investigator and whether the contact involves voluntary questions, requested consent, or compulsory legal process. Each carries different obligations. An interview can have consequences before an arrest, while a request for cooperation does not necessarily require compliance.

Separate Voluntary Questions from Custodial Interrogation

You may decline a voluntary interview and request an attorney. If your status is unclear, ask whether you are free to leave. Clearly state that you wish to remain silent and want an attorney before answering investigative questions.

Miranda warnings generally apply to custodial interrogation, not every police conversation. Missing warnings do not automatically dismiss charges. Admissibility may depend on custody, questioning, waiver, voluntariness, and exceptions. State constitutional protections can also affect the analysis.

Read Warrants and Subpoenas Separately

A consent request differs from a search under a warrant or recognized exception. You can state that you do not consent without physically resisting officers. Retain any warrant copy, inventory, or receipt provided.

Do not ignore a subpoena. Record its issuing authority, service date, return date, and requested scope. An attorney can review objections and privilege issues before you respond. Declining a voluntary interview does not excuse compliance with compulsory process.

4. Preserve Records That Can Test the Allegations

Focus on records connected to identity, timing, permission, intent, location, or the sequence of events. Preserve originals where possible. Privately held footage and account data may disappear through routine deletion before prosecutors disclose their evidence.

Keep Complete Records and Their Sources

Save full conversations, timestamps, attachments, and original files rather than selected screenshots alone. Note who supplied a recording and whether its displayed time is accurate.

Prioritize:

  • Messages, receipts, and location records relevant to the alleged event.
  • Camera locations where footage may be overwritten.
  • Witness names and contact information for your attorney.

Do not delete unfavorable material, edit recordings, or coordinate witness accounts. Tell your attorney promptly about records approaching deletion so lawful preservation steps can be considered.

Compare Your Records with Disclosed Evidence

CPL Article 245 governs automatic discovery in state criminal cases, subject to statutory limits and protective orders. Relevant statements, recordings, and reports may fall within disclosure obligations. Federal cases follow separate disclosure rules.

Compare disclosed criminal evidence with your records by time, source, and disputed fact. Flag missing context without assuming that a discrepancy proves misconduct. Give your attorney the original material, a short chronology, and specific questions about unexplained differences.
