What Should a Santa Clara County Probate Attorney Review before Filing?

业务领域:Estate Planning

Probate attorney Santa Clara County searches often focus on what must be checked before a petition is filed.

A will is only one part of that review. Before filing, an heir or proposed executor should identify which assets belong in the probate estate, who must be identified as an heir or devisee, and which records support those facts. Those answers shape the petition and may also show whether formal probate is necessary.

1. Start with an Asset Map, Not the Will

Whether property enters probate usually depends first on ownership and transfer arrangements.

Property held in a funded trust may be governed by the trust. An account with a valid beneficiary designation may transfer directly to the beneficiary, while property held with survivorship rights may pass to the surviving owner.

Property held solely in the decedent's name requires a different review. Depending on the type and value of the property, California may require formal administration or permit a simplified transfer procedure.

A probate administration review should therefore compare:

Deeds and title records;

  • Bank and investment accounts;
  • Beneficiary designations;
  • Trust and transfer documents;
  • Business ownership records; and
  • Significant property held solely by the decedent.

This classification should come before the petition is drafted. A will may direct who receives probate property, but it does not make every asset part of the probate estate.

2. Match Each Filing Fact to a Source Record

California Probate Code § 8002 requires a petition for administration to include information about the decedent, heirs and devisees, estate property, and the person whose appointment is requested.

The records gathered before filing should support those petition facts rather than merely show that the decedent owned property.

Check the Original Will Separately

If a will is offered for probate, § 8002 requires a photographic copy to accompany the petition. Additional requirements apply to materially handwritten or foreign-language wills.

The original serves a separate function. Under Probate Code § 8200, unless a probate petition has already been filed, the custodian generally must deliver the original will to the appropriate superior court within 30 days after learning of the testator's death. Santa Clara County also requires its Will Coversheet when a will or codicil is submitted.

A family photocopy therefore should not be treated as a substitute for locating the original.

Identify Heirs and Devisees Correctly

The petition may require both heirs and devisees to be identified, and the two groups are not necessarily the same.

A devisee receives property under the will. An heir is someone who would inherit under California intestate succession. Marriage, birth, adoption, and other family records may therefore matter even when a will exists.

If no controlling will governs the property, California intestacy rules determine who receives probate assets.

Confirm Ownership Beyond Account Balances

A balance or property value does not establish how an asset transfers at death.

A bank statement may not reveal a beneficiary designation. A deed must be checked for the form of ownership. A trust may exist even though a particular asset was never transferred into it.

Comparing the underlying records helps distinguish property that belongs in the probate estate from property that may pass outside it.

3. Separate Executor Nomination from Court Authority

Being named executor in a will does not by itself create full authority to administer a probate estate.

Formal authority generally follows court appointment and issuance of the appropriate Letters. Until then, a bank, title company, or other institution may require court-issued proof before recognizing the proposed executor's authority over estate property.

After appointment, Probate Code § 9650 gives the personal representative the right and duty to take possession or control of property to be administered, collect debts due to the decedent or estate, and take reasonably necessary steps to manage and preserve estate property.

Later administration may involve inventory and appraisal, creditor claims, taxes, accounting, and distribution. Those later stages are distinct from the narrower issue addressed here: what must be established before and at the initial filing.

If the dispute concerns ownership, beneficiary rights, the validity of a transfer, or fiduciary conduct, the matter may move beyond routine administration into estate litigation.

4. Santa Clara County Procedure Matters at Filing

California law controls the substantive probate questions. Santa Clara County's distinct role is primarily procedural.

Decedent's estate matters proceed through the Probate Division of the Superior Court of California, County of Santa Clara. Its Local Probate Rules supplement the Probate Code and statewide California Rules of Court for local filing and calendar practice.

For a probate Santa Clara County case review, the filing analysis should separate:

  • California law: whether probate is required, who may petition, which parties must be identified, and what facts support the requested appointment.
  • Santa Clara County procedure: how the will and related documents are submitted and which local filing and calendar requirements apply.

This distinction keeps statewide law and county procedure from being blended together. The requirement to identify heirs, for example, comes from California probate law. The Santa Clara County Will Coversheet is a local filing requirement.

Questions about how property passes under a will may also involve testamentary succession, but the probate petition remains governed by California law and applicable local court procedure.

Federal law generally does not determine whether a California probate proceeding is opened. Federal tax or priority issues may arise later in administration, but they do not replace California's rules for commencing the probate case.
