What the agreement has to settle
A settlement agreement in an uncontested divorce generally addresses how property and debts are divided, whether either spouse will receive maintenance, and, when there are children, custody, parenting time, child support, and health coverage. Leaving a topic out does not make it disappear; it can leave the issue open to dispute or, in some cases, waived without either of you meaning to. Retirement accounts often need separate orders after the agreement is signed, and the agreement should say who prepares them. Real estate needs a plan for both the deed and the mortgage, since a lender is not bound by the divorce. The more specific the terms, the fewer questions arise when the agreement has to be carried out.
Formalities that New York enforces
New York attaches a formality to marital agreements that catches people off guard: the signatures generally have to be acknowledged in the way a deed is, which in practice means before a notary with a proper certificate. An agreement missing that step can be unenforceable even if both spouses meant every word. Child support terms carry their own required statements about the state guidelines, especially when the agreed amount departs from the guideline figure. Courts review child-related terms to see that they serve the children and can decline to approve terms that fall short. Signing quickly to be done is understandable, but each spouse should have time to review the full agreement, ideally with separate counsel.
Reviewing a draft before anyone signs
Many couples arrive with a draft from an online service or one prepared by one spouse's lawyer. We read it against your finances and family situation, looking for missing assets, unclear payment terms, and provisions that will be hard to enforce or modify. Some terms, such as how property was divided, are usually final once signed, while child-related terms can be revisited when circumstances change.
