What Is Copyright Infringement and How Do Remedies Work in New York?
A copyright claim requires two elements: ownership of a valid copyright, and copying of protected original expression. Direct evidence of copying is rare, so in the Second Circuit it is ordinarily established by showing access to the work together with substantial similarity, judged from the perspective of an ordinary observer. Registration controls more than it appears to. Under 17 U.S.C. § 411(a) an action cannot be brought until the Copyright Office has acted on the application — not merely received it (Fourth Estate Public Benefit Corp. .. Wall-Street.com, 586 U.S. 296 (2019)). And under § 412, statutory damages and attorney's fees are available only where the work was registered before the infringement began, or within three months of publication. Without that, recovery is limited to actual damages and the infringer's profits. Where statutory damages are available, the range is $750 to $30,000 per work, up to $150,000 for willful infringement and as low as $200 where the infringement was innocent (§ 504(c)). Injunctive relief is available under § 502 and impoundment under § 503. Claims are subject to the three-year period in § 507(b).
