Two deadlines run at the same time, and the shorter one is easy to miss. The general period is three years under CPLR § 214 for personal injury. Suing a municipality compresses that considerably. A notice of claim is due within ninety days under General Municipal Law § 50-e, and the action itself must be commenced within one year and ninety days under § 50-i — not three years. Missing the notice is not always fatal; late filing may be permitted by leave of court, but that is an application rather than a right. A municipality may also demand a hearing under § 50-h before suit. Failing to appear can bar the action entirely. Different defendants, different rules. Claims against the State proceed in the Court of Claims under its own statute. Transit and housing authorities have their own requirements.
