Estate Planning: How Lifetime Gifts Affect Your Inheritance

A gift within the annual exclusion has no effect on the donor's lifetime exclusion. For 2026 that amount is $19,000 per recipient, or $38,000 where spouses elect to split gifts. Only the excess counts against the lifetime figure, which is $15 million per person in 2026, and it is the excess that triggers a Form 709, due April 15 of the following year. New York matters here for two reasons, and neither is a state gift tax — New York repealed that in 2000. The first is the three-year add-back under Tax Law § 954(a)(3): taxable gifts made by a New York resident within three years of death are added back into the New York gross estate, so a deathbed transfer does not remove the asset from the state computation. The second is the cliff. New York's basic exclusion is $7.35 million for 2026, and an estate exceeding 105 percent of that figure is taxed on its entire value rather than on the excess. An estate just over the line can owe substantially more than one just under it, which is what makes the timing and size of lifetime gifts worth working out in advance rather than after. One point runs the other way. Property transferred by gift carries the donor's basis, while property passing at death generally receives a basis step-up to the date-of-death value. For appreciated assets, gifting can shift an income tax cost to the recipient that would not have arisen had the asset been held.
