Fraud is one of the four statutory grounds. Under 9 U.S.C. § 10(a)(1) an award may be vacated where it was procured by corruption, fraud, or undue means, and the courts apply a three-part test: the fraud must be shown by clear and convincing evidence, it must not have been discoverable by due diligence before or during the hearing, and it must be materially related to an issue in the arbitration. The deadline is short and jurisdictional in effect. Notice of a motion to vacate must be served within three months after the award is filed or delivered under § 12, and a party that lets the period run generally cannot raise the same grounds defensively when confirmation is sought. An award under the CPLR follows a different clock, with ninety days from delivery under CPLR 7511. Correcting the record is narrower than reopening the merits. A court reviewing a § 10(a)(1) petition does not reweigh the evidence, and a false statement by a witness is not itself a ground where the issue was litigated before the tribunal. Where the award has already been confirmed, relief runs through Rule 60(b)(3) on the judgment, subject to its one-year limit.

A civil damage award is a monetary judgment a court orders a defendant to pay a plaintiff after finding liability in a civil lawsuit. The amount depends on proof of actual losses, applicable law, and the strength of evidence presented at trial or settlement. New Jersey courts follow statutory damages frameworks and common-law principles that define what losses may be recovered. Procedural defects in pleading, discovery, or proof can result in reduced awards or dismissal before trial. This article covers how civil damage calculations work, what types of losses qualify for recovery, and the role of legal representation in building a damages case.

Motorcycle accident law in NYC governs No-Fault exclusions, shared fault, insurance coverage, and compensation for injured riders. Unlike car occupants, riders and passengers on qualifying motorcycles cannot obtain ordinary No-Fault benefits. They generally need not meet the serious injury threshold to claim pain and suffering from a negligent driver. Vehicle classification, comparative fault, and insurance terms can affect recovery.

An invention disclosure is a formal document that records the conception and development of a novel creation, typically submitted to an employer, patent counsel, or institutional review body to establish priority, ownership, and patentability. The accuracy and timeliness of invention disclosures directly affect patent eligibility, inventorship disputes, and trade secret protection under federal and state law. Procedural defects in disclosure timing or completeness can result in loss of patent rights, unenforceability claims, or weakened trade secret status. This article examines the legal framework governing invention disclosures, the consequences of inadequate documentation, and the practical considerations that shape ownership and enforcement posture.

Alimony disputes turn on statutory formulas, discretionary judicial factors, and the quality of financial disclosure, making the difference between a sustainable support order and one that leaves you vulnerable to modification battles or enforcement gaps. In New York, spousal support is governed by the Domestic Relations Law, which establishes both guideline and non-guideline frameworks depending on income levels and the length of the marriage. As counsel, I often advise that the scope of discovery, the accuracy of income calculations, and the timing of motions in the matrimonial court can reshape the entire support landscape before trial. Courts have broad discretion to award maintenance, impute income, and consider factors such as the standard of living during the marriage, the earning capacity of each party, and contributions to the household, making early strategic positioning critical.
