How NYC Probate Works: a Step-by-Step Guide to Estate Administration

Probate in New York City begins with filing the decedent's will in the Surrogate's Court of the county where the decedent was domiciled — each of the five boroughs has its own court. The proceeding determines whether the will is valid. Once it is admitted, the court issues letters testamentary to the executor the will names; where there is no will, the court appoints an administrator instead. The executor then gives notice to the decedent's distributees, collects and inventories the assets, pays debts and taxes, and distributes what remains. Three periods matter. Under SCPA 1802, an executor who waits seven months from the issuance of letters may distribute without personal liability for claims that were never presented. Under SCPA Article 13, an estate with less than $50,000 in personal property can proceed by voluntary administration rather than full probate. And under EPTL 5-1.1-A, a surviving spouse may elect against the will for the greater of $50,000 or one-third of the net estate, within six months of letters and no later than two years after death. Not every asset passes through the proceeding. Jointly held property, accounts with named beneficiaries, and assets held in trust transfer outside it, which sometimes leaves a probate estate too small to cover the debts.
