Foreign Tax Credit Claims for Dividend and Royalty Withholding Tax

A domestic corporation that pays foreign withholding tax on dividends or royalties may claim a direct credit under 26 U.S.C. § 901, reported on Form 1118. Two things determine whether the credit is actually available. The first is whether the foreign tax is creditable at all. The 2022 final regulations narrowed that definition, and a number of foreign withholding taxes on royalties — along with most digital services taxes — ceased to qualify. Notice 2023-55 allowed taxpayers to apply the prior rules for 2022 and 2023, and proposed regulations added an exception for royalties paid under a single-country license: one that designates the payments as royalties and limits the licensed territory to the taxing country, or a multi-country agreement that separately states the amount attributable to that country. Those regulations remain proposed, so the position for a current year should be confirmed before filing. The practical consequence is that dividend withholding and royalty withholding do not behave the same way, and how the license is drafted can decide the credit. The second is the limitation under § 904. The credit cannot exceed the US tax on foreign-source income, computed separately for the passive, general, GILTI, and foreign branch categories, so whether a royalty falls in the passive or general basket changes the result. Unused credits carry back one year and forward ten — except in the GILTI basket, where they cannot be carried at all. Where a treaty reduces the withholding rate, claiming that reduction at source is usually preferable to paying the full rate and seeking a credit that may be limited or non-creditable.

How Can the Public Health Service Act Assist Medical Harm Victims?

The Public Health Service Act is a federal statute that establishes federal funding, research authority, and regulatory frameworks for public health programs, and it also contains critical provisions that protect individuals harmed by federally funded health programs and medical professionals. One key requirement is that entities receiving federal health service funding must comply with anti-discrimination and patient safety standards set by the statute and its implementing regulations. Procedural defects in how a health program documents or handles harm complaints can undermine your ability to establish a valid claim or participate meaningfully in oversight processes. This article covers the statutory scope of the Public Health Service Act, how it protects victims, the federal agencies that enforce it, and what documentation and procedural steps matter when asserting rights under this framework.

How Are Standard Drug Testing Protocols Actually Executed?

The legal framework governing testing differs depending on whether the test occurs in an employment context, criminal investigation, probation supervision, or other setting. Knowing the procedural rules and evidentiary standards that apply to your specific situation helps you understand what evidence may be used against you and what defenses or procedural protections may be available.

Commercial Real Estate Litigation: What Property Owners and Investors Need to Know

In a commercial property dispute, the filing itself can be the leverage. A notice of pendency stops the property from moving. Filed with a claim affecting title or possession, it appears in the record and effectively halts a sale or a financing while the case runs. That is often worth more to a plaintiff than any judgment — and it is why the decision to file is made early, before the merits are fully developed. It also carries exposure. A notice filed without a proper basis can result in liability, and courts will cancel one that does not belong. Whether to file is the first real question in these cases. Real property is treated as unique, which means specific performance is available where a purchase agreement is breached. A buyer who wants the building, rather than damages measured against it, has a remedy that most commercial disputes do not offer. On the seller's side, the deposit usually stays. New York enforces forfeiture of a contract deposit against a defaulting purchaser without requiring proof of actual loss — a result that surprises buyers who assume they will be made whole. Most of these resolve before trial, and the terms are shaped by which of the above applies. Whether the property is encumbered, whether performance can be compelled, and who holds the deposit determine what a settlement looks like long before a courtroom does.
