When Is a New York Statutory Short Form Power of Attorney Effective?

A New York statutory short form power of attorney generally takes effect for an agent when that agent's signature is acknowledged. The principal must execute the document with capacity, an acknowledged signature, and two qualified witnesses under General Obligations Law § 5-1501B. Joint appointments or a specified future event can delay authority. The document covers selected financial powers, not medical decisions, and ends at the principal's death.

New York Residency Audit Findings Depend on Domicile and Days

New York residency audit findings depend on domicile, days spent in the state, and whether you maintain a permanent place of abode.Spending more than 183 days in the state can establish statutory residency when a permanent place of abode is also maintained. Perm Labor Certification Suspensions and Employee Green Card Plans

PERM labor certification suspensions at selected employers may delay green card plans, depending on filing status and case stage. Affected employees should confirm the sponsoring employer’s legal name, whether their PERM application was filed, and its current status. A processing pause differs from a denial and does not itself cancel immigration status. Cases already at the I-140 or I-485 stage require separate review.

How Duty Drawback Lawyers Protect Your Import Duty Refunds

Unused merchandise drawback refunds 99% of the duties, taxes and fees paid on imported goods that are exported or destroyed without being used in the United States. Claims are filed electronically and must be made within five years of the date of importation. Two routes exist. Direct identification under 19 U.S.C. § 1313(j)(1) covers the same merchandise that was imported. Substitution under § 1313(j)(2) covers other merchandise classified under the same 8-digit HTS subheading, a test that replaced the former commercial interchangeability standard. In either case CBP must be given the opportunity to examine the goods before export, which means filing prior notice on CBP Form 7553 or holding a waiver of prior notice privilege. Eligibility depends on which tariff was paid. Section 301 duties are recoverable. Section 232 varies by proclamation — some categories permit only manufacturing drawback and others state that no drawback is available — so the controlling proclamation for each entry governs. Duties imposed under IEEPA are a separate matter following the Supreme Court’s February 2026 decision, handled through CBP’s refund process rather than through drawback. Accelerated payment allows a claimant with an approved bond to receive the refund before liquidation. If the claim is later denied, the amount must be repaid, so the privilege shifts the timing of the recovery rather than removing the risk.
