Treaty relief is obtained before payment, not at filing. A resident of a treaty country reduces withholding at source by furnishing Form W-8BEN or W-8BEN-E to the payor, with the limitation-on-benefits certification completed. A treaty-based return position must then be disclosed on Form 8833 under § 6114, and failure to do so carries a penalty of $1,000 for an individual and $10,000 for a corporation under § 6712. The sequence matters because of how the foreign tax credit works. Under Treas. Reg. § 1.901-2(e)(5), only a compulsory payment of foreign tax is creditable, and the taxpayer is expected to exhaust effective and practical remedies, including treaty relief and competent authority procedures. Tax paid at a statutory rate that a treaty would have reduced may therefore be non-creditable — the overpayment is neither recovered abroad nor credited at home. Where both countries have in fact taxed the same income, relief runs through the mutual agreement procedure under the treaty’s competent authority article, with the US process set out in Rev. Proc. 2015-40. The request is subject to the time limit in the applicable treaty, commonly three years from the first notification of the action giving rise to the double taxation.

Where a commercial dispute goes in New York affects the timetable as much as the merits. In New York County, a case with at least $500,000 in controversy is assigned to the Commercial Division, which operates under its own rules — limits on the number of depositions and interrogatories, a defined sequence for expert disclosure, and an accelerated adjudication procedure the parties can elect. Thresholds differ by county, so the same claim may proceed very differently depending on where it is filed. Fraud claims carry a pleading requirement that other claims do not. Under CPLR 3016(b), the circumstances constituting the fraud must be stated in detail, and a complaint that pleads the elements generally is vulnerable on a motion to dismiss before any discovery. The limitations period is six years from accrual or two years from discovery, whichever is later (CPLR 213(8)). Where there is reason to believe assets will be moved, an attachment under CPLR 6201 is available before judgment on specified grounds, including that the defendant is a non-domiciliary or is disposing of property with intent to frustrate enforcement. That application is made early or not at all.

This article covers principal defenses available to defendants in trucking and motorcycle accident cases, the burden-of-proof framework, comparative negligence rules, and tactical considerations that may protect your interests in litigation or settlement.

Unregistered designs protect original product appearance without registration, but enforcement depends on proving originality, disclosure, copying, and substantial similarity through strong evidence and litigation strategy.
