ERC disallowance does not always end your claim, but an ERC appeal does not automatically extend the deadline to file a refund suit. If your ERC claim was denied, first identify the affected quarters, the IRS’s stated reasons, and the notice date. Employers can use those details to prepare supporting records, request an appeal, and track the separate refund suit deadline. The next step depends on whether you just received the notice or are already awaiting a response.

A discovery dispute can become urgent when a request reaches sensitive information or creates a serious burden. Before filing, the moving party generally must try in good faith to resolve the dispute. The motion should explain why the requested protection fits the problem.

A subcontractor is not the only employer that can be cited. Under OSHA’s multi-employer citation policy, a controlling, creating, correcting, or exposing employer may each be cited for the same condition, so a general contractor with authority over the site can be cited for a subcontractor’s violation even where none of its own employees were exposed. For 2026 the maximum is $16,550 for a serious violation and $165,514 for a willful or repeat violation. The contest period governs everything that follows. A notice of contest must be filed within fifteen working days of receipt, and a citation that is not contested becomes a final order of the Commission not subject to review, which also fixes it as a predicate for a later repeat characterization. Civil exposure runs on separate tracks. New York Labor Law §§ 240 and 241(6) impose liability on owners and general contractors regardless of their own fault, and an OSHA citation is evidence in that action without being dispositive. A contractual indemnity provision reaching the indemnitee’s own negligence is void under General Obligations Law § 5-322.1, which is why these agreements are written to the fullest extent permitted by law with insurance procurement as a separate covenant.
