How Does a Tax Appeal Attorney in Long Island Lower Your Property Taxes

The first step differs by county. In Nassau County the grievance is filed with the Assessment Review Commission during the period that opens in early January and closes March 1, on the Commission’s own application form. In Suffolk County each town has a Board of Assessment Review, and the complaint must be filed by Grievance Day, the fourth Tuesday in May under RPTL § 512, unless the town has adopted a different date. An administrative determination is not the end of the matter. For an owner-occupied residence of three units or fewer, a Small Claims Assessment Review petition may be filed under RPTL § 730 within thirty days after the final assessment roll is filed, with a filing fee of $30. A commercial property or a larger claim proceeds instead by petition under RPTL Article 7, also within thirty days of the filing of the final roll. What the proceeding decides is the assessment, not the tax rate. The two grounds that matter are overvaluation, measured against the property’s market value on the applicable valuation date, and inequality, measured against the municipality’s residential assessment ratio or the equalization rate for the year. Comparable sales from that period carry the claim; the amount of the tax bill is not itself a ground.
