Power of Attorney and Estate Planning: What Your Will Cannot Do Alone

In New York, financial and medical authority require two separate documents. A power of attorney covers property and finances. A health care proxy covers medical decisions. Neither substitutes for the other, and clients who sign only the first frequently believe they have addressed both. Without them, the alternative is a guardianship proceeding — a court filing, a hearing, and a guardian subject to ongoing reporting obligations. Courts do consider family members, but the process itself takes months and costs considerably more than the documents would have. The statutory form changed in 2021, with revised execution requirements including two witnesses. Documents signed under the prior version remain valid, though financial institutions sometimes resist them. Gifting authority is not automatic. An agent cannot make substantial gifts unless the power of attorney expressly grants that authority in the modifications section. Plans that depend on lifetime transfers fail without it. And these documents can only be signed while you still have capacity. After that, guardianship is the only route left.

Overseas Entity Workplace Accident Investigation Defense in Manhattan

OSHA has no foreign-employer exemption. An entity with employees at a US worksite is subject to the Act regardless of where the parent is incorporated, and the reporting periods are the same: a fatality within eight hours of the employer learning of it, an in-patient hospitalization, amputation or loss of an eye within 24 hours, and a citation contested within 15 working days of receipt or it becomes final. Insurance is where a foreign employer’s exposure usually sits. A parent’s global policy does not satisfy New York’s workers’ compensation requirement, and under Workers’ Compensation Law § 11 an employer that has not secured compensation can be sued directly by the injured employee for damages — the exclusivity that normally bars tort claims against the employer does not apply. Confirming the US subsidiary’s coverage is therefore a more urgent item than the OSHA response. On the investigation itself, the company’s and the officers’ positions are not identical, and company counsel does not represent individual managers. What must be produced is a legal question to be answered before documents are gathered, and responses across OSHA, the insurer and any civil claim have to be factually consistent, since each becomes available to the others.
