New York residents carrying credit card balances and medical bills have several paths, and they are not variations of one thing. Settlement and consolidation are contractual arrangements with creditors. Bankruptcy is a federal court proceeding, and it is the only one of the three that stops collection, through the automatic stay under 11 U.S.C. § 362. Until a case is filed, a creditor may continue to sue, obtain a judgment, and garnish wages.Between the two consumer chapters, the distinction that usually decides the choice is what each can and cannot do. Chapter 7 discharges unsecured debt but requires passing the means test and cannot cure arrears on a mortgage or car loan. Chapter 13 requires regular income and a three-to-five-year plan, and it is the chapter that allows a homeowner to cure a default over time rather than surrender the property. Exemptions determine what a debtor keeps, and New York requires a choice rather than a combination. A debtor elects either the state scheme — the homestead exemption under CPLR 5206, which is tiered by county, together with the personal property exemptions in CPLR 5205 — or the federal exemptions under § 522(d), which New York permits by Debtor and Creditor Law § 285. The two sets cannot be mixed, and which produces a better result depends on whether there is equity in a home. Not everything is dischargeable. Credit card balances and medical bills generally are. Student loans are not, absent a showing of undue hardship; recent tax liabilities, child support, and maintenance obligations also survive. A case built around debts that will remain after discharge does not accomplish what the filer expected, which is why the composition of the debt matters as much as its total.
