A negligent security claim can depend on who controlled the property, what security measures were reasonably required, and what evidence remains available. For an injured plaintiff, the important decisions often come after identifying a possible claim: whether to pursue the property operator, a security contractor, or both; whether an early settlement reflects the available evidence and losses; and whether the case belongs in small claims or a civil action. The deadline is 90 days. A Notice of Deficiency may be contested by petitioning the Tax Court within 90 days of the date of the notice — 150 days if it was addressed to a person outside the United States — and the period is jurisdictional under § 6213(a). Once it lapses the deficiency is assessed and the dispute moves to collection. That deadline also sets the forum choice. Petitioning the Tax Court requires no prepayment of the tax. The alternative is to pay in full and sue for a refund in the district court, where a jury is available, or in the Court of Federal Claims — but full payment is a precondition, so the choice is made before the money is spent, not after. New York runs on a separate clock. Under Tax Law § 211(3) a corporation must report a final federal determination to the state within 90 days, or 120 days if it files a combined report, with any refund claim due two years after that reporting deadline. Reporting late does not forfeit the tax but stops interest from accruing on the portion attributable to the federal change.
