The preliminary hearing comes first and sets the case. It must be held within ten court days of the arraignment or plea under Penal Code § 859b, the standard is probable cause rather than proof beyond a reasonable doubt, and a defendant held to answer may move to dismiss under § 995 in the superior court. Sentencing exposure is now constrained by statute. Under § 1170(b) the court must impose the middle term unless aggravating circumstances have been stipulated to or found true beyond a reasonable doubt by a jury, and § 1170(b)(6) requires the lower term where the defendant’s youth, psychological trauma or intimate partner violence was a contributing factor. Enhancements are where the real length lies. Section 12022.53 adds consecutive terms of ten, twenty or twenty-five years to life for firearm use in enumerated offenses, and § 1385(c) now directs the court to dismiss an enhancement where doing so furthers justice, with a list of mitigating circumstances that weigh greatly in favor of dismissal.
