Elements of Unjust Enrichment in Animal Disputes

New York treats animals as property. That single fact shapes every claim in this area, including what you can recover. Unjust enrichment has three elements here — the other party was enriched, at your expense, and equity requires restitution. But it is not available where a valid contract governs the same subject matter. A boarding facility that took fees and provided nothing has breached a contract; the claim is a contract claim, and pleading unjust enrichment alongside it will be dismissed. Where it fits is where no contract does. Someone who cared for an animal for years under an informal arrangement and then lost it. Breeding proceeds retained where the parties never agreed how to split them. Costs advanced on another's animal with no agreement about repayment. Where someone sold your animal, the claim is conversion or replevin, not restitution — and replevin can get the animal back rather than its value. What limits every claim is the same thing. Damages for property generally run to market value. New York courts have been reluctant to recognize loss of companionship or emotional distress, and a pet's worth to you is not the measure. That gap between what the loss feels like and what the law compensates is worth understanding before filing.
