
The deadline is 65 days, not 60. SSA presumes you received the notice five days after it was dated, and that presumption is built into the rule. People miss the date because they counted from the wrong number. The disability standard does not change at any stage. The same five-step analysis applies from the first denial to federal court. What changes is who is looking and what they are allowed to look at. Reconsideration is a paper review by a different examiner at the state agency. New evidence is welcome and often decisive. The ALJ hearing is the only stage where you appear, testify, and question the vocational expert. It is the last stage where the record is genuinely open — and evidence must be submitted or identified at least five business days before the hearing, or the judge may refuse to consider it. The Appeals Council reviews whether the ALJ made a legal error or ignored the evidence. It is not a second hearing, and new evidence faces real restrictions. Federal court reviews the administrative record for substantial evidence. Nothing new gets in. Missing a deadline is not always fatal. Good cause can excuse a late filing, and you can always file a new application. What you lose is the retroactive period — which, for a claim that has been pending two years, is usually the largest part of the award.
