New York's lemon law does not ask whether the car underperformed. It counts repair attempts. The presumption arises from a defined pattern — four unsuccessful attempts to repair the same defect, or thirty days out of service, within the statutory period. Meeting that pattern shifts the analysis in the consumer's favor. Written notice to the manufacturer is part of it. New and used vehicles run on different statutes. New car claims are against the manufacturer. Used car claims are against the dealer, under a warranty whose length depends on the vehicle's mileage and age at sale — and a dealer's "as is" disclaimer does not remove it. The remedy is a refund or a replacement, at your election. A refund is reduced by an allowance for the mileage driven before the first repair attempt, so the figure is not the full purchase price. Arbitration comes before litigation for most claimants. The State operates a program that is faster and less expensive than court, and the choice belongs to the consumer. Attorney's fees are recoverable. For a claim whose value would otherwise not justify the cost of pursuing it, that provision is what makes the case viable.
