Most people call it alimony. New York calls it maintenance, and the difference is more than vocabulary — it is calculated rather than argued.Since 2015, both maintenance and child support run on statutory formulas up to an income cap. Above that cap a court has discretion. Below it, the numbers largely follow the inputs. Which is why custody drives the money. Custody determines who pays. And where the same person owes both, maintenance is calculated first and subtracted from income before child support is run on what remains. A change in the parenting arrangement moves both figures at once. The real fight is over income. A court is not bound by what a tax return says. It can impute income from earning capacity, from a business run in cash, from perquisites paid through a company. In most contested cases, that is where the case is actually won or lost.
