
Compliance failures rarely end with a fine. They end with a consent order that restricts what the institution may do next. The federal layer has more parts than the prudential regulators. The OCC, Federal Reserve, and FDIC examine safety and soundness. Consumer protection runs on a separate track through the CFPB, whose supervisory reach depends on asset size — and whose rules apply regardless of who examines you. And the federal layer is not the top one. State regulators impose their own requirements, and in New York several exceed the federal standard. Passing a federal examination does not resolve a state one. Fair lending is where enforcement is concentrated. Disparate impact does not require intent, and an underwriting model that produces divergent outcomes across protected classes creates exposure whether or not anyone designed it that way. Institutions using algorithmic credit decisioning are frequently unable to explain their own models to an examiner — which is itself a finding. The consequences compound. A downgraded examination rating can block acquisitions, branch applications, and new product launches. Consent orders become public. And enforcement reaches individuals: officers face personal penalties and prohibition from the industry.
