What a Trust and Estate Lawyer for Real Estate in New York Can Do for Your Property

A trust and estate lawyer for real estate in New York navigates probate procedures, deed recording, and tax strategy to protect your property. Learn how real estate fits into your estate plan and what steps your attorney should take before, during, and after probate. In my experience working with New York property owners, real estate is almost always the most complicated, and most valuable, asset in any estate. A trust and estate lawyer for real estate in New York helps you structure how property is titled, how it moves through Surrogate's Court, and how your heirs avoid unnecessary capital gains taxes. Without proper coordination between your deed, your will, and your trust documents, even a well-intended estate plan can fall apart the moment a property needs to transfer. A qualified trust and estate lawyer for real estate in New York will identify those gaps before they become costly problems for your family.

How Do M&A Attorney Fees Work in New York Corporate Deals?

New York requires a written engagement letter. That is not a best practice — it is a rule. Under Part 1215, a firm expecting to bill more than $3,000 must provide one, stating the scope of the work, the fee, the billing arrangement, and your right to have a fee dispute resolved through the state's arbitration program. If you have not received one, you have not been engaged on terms either side can rely on. What actually drives the number is not the purchase price. It is the volume of diligence, the number of counterparties whose consent you need, whether regulatory approvals are required, and how many times the structure changes before signing. A modest deal with fragmented ownership and a licensing issue costs more than a larger clean one. Budget for the deal that does not close. Most of the fee in an M&A engagement is incurred before signing. A transaction that dies in diligence — which is a good outcome when diligence finds something — still costs most of what a completed one would. On success fees, ask the obvious question. A lawyer paid only on closing has a financial interest in the deal closing. Part of what you are paying for is candid advice about walking away. Where the fee is equity rather than cash, New York's rules on business transactions with clients apply, requiring written disclosure and a real opportunity to consult independent counsel. These arrangements are permitted and sometimes appropriate. They should be discussed rather than assumed. What is outside scope matters as much as what is in it. Antitrust filings, tax opinions, benefits work, and counsel in other jurisdictions are frequently separate. A cap on the main engagement means little if the surrounding work is uncapped.
