A court will dismiss for failure to exhaust administrative remedies without reaching the substance. There are narrow exceptions; assume none applies to you. Four months, from finality. An Article 78 proceeding must be commenced within four months of the determination becoming final and binding — and when a determination became final is itself frequently litigated. Waiting for a reconsideration you were not entitled to request does not stop the clock. The record deadline is invisible. Nothing tells you the hearing was your last chance to put evidence in.
