Child support is not deductible by the payor and not taxable to the recipient. Neither is spousal maintenance in orders entered after 2018. That closed a planning option. Parties once shifted value between maintenance and child support to allocate the tax benefit. Since the federal change, the two are treated alike, and the only remaining question is whether a pre-2019 order being modified retains its original treatment — which depends on how the modification is worded. The dependency exemption is negotiable and often unaddressed. It belongs to the custodial parent by default and can be released to the other parent by written form. A substantial change in circumstances, three years since the last order, or a fifteen percent change in either parent's income — the second and third requiring no separate showing, unless the order opted out of them.Arrears are not reduced retroactively. Relief runs from the filing date, not from when circumstances changed.
