In most Chapter 7 cases, unsecured creditors receive nothing. Knowing that early is worth more than any recovery analysis. Secured claims come off the top, up to the value of the collateral. What remains funds the trustee, professional fees, and priority claims — wages and taxes, within statutory caps — before general unsecured creditors see a pro rata share of whatever is left. Frequently there is no such thing. Avoidance runs both ways. A trustee can recover preferential payments made in the ninety days before filing and fraudulent transfers made well before that. This enlarges the estate, which helps creditors generally. It also means a creditor who was paid shortly before the filing may be asked to return the money. Two deadlines matter more than the analysis. The bar date for filing a proof of claim — miss it and you are out regardless of the merits. And the deadline to object to discharge of a particular debt, which is short and runs from the creditors' meeting. Debts incurred through fraud are not discharged, but only if someone brings the proceeding in time. The creditors' meeting is an opportunity, not a formality. It is the one occasion to examine the debtor under oath without discovery motions, and what surfaces there frequently determines whether a case is worth pursuing further. Do not attempt collection after the filing. The automatic stay is immediate and violations carry sanctions, including where the creditor did not know of the filing.
