What Does a Tax Fraud Lawyer in San Jose Review in a Case?

Практика:Finance

Автор : Donghoo Sohn, Esq.

A tax fraud lawyer in San Jose examines alleged false statements, intent, financial evidence, and the applicable federal or California tax laws.

An incorrect tax return does not automatically establish fraud. Contracts, payment records, and communications may explain why reported figures differ from actual transactions. The legal question is whether the evidence supports a reporting error, deliberate tax misconduct, or a separate civil fraud claim.

1. What Makes a Tax Statement Fraudulent under Federal Law?

Federal law distinguishes tax evasion from signing a materially false return. Each offense has its own elements, so an inaccurate figure alone cannot establish guilt. A tax fraud review starts with the alleged conduct and the statute prosecutors would need to prove.

False Statements, Materiality, and Willfulness

Under 26 U.S.C. § 7206(1), a person may face prosecution for willfully signing a return under penalties of perjury while knowing it contains a materially false statement.

Materiality concerns whether the statement could influence the IRS in performing its functions. This offense does not require proof of an actual tax deficiency.

Willfulness generally requires an intentional violation of a known legal duty. A genuine good-faith misunderstanding of tax law, even if objectively unreasonable, may negate willfulness.

Tax Evasion Versus Filing a False Return

Under 26 U.S.C. § 7201, prosecutors generally must prove a tax due and owing, an affirmative attempt to evade assessment or payment, and willfulness.

False accounting entries, concealed income, or disguised ownership may provide evidence of an affirmative act. Failure to pay an assessed tax, without more, does not establish evasion.

Section 7206(1) instead concerns knowingly signing a materially false return with the required willfulness. Unlike § 7201, it does not require proof of unpaid tax.

2. Financial Records That Distinguish Fraud from Error

Bank deposits and reported income may differ for legitimate reasons. The underlying transaction, accounting method, and information available when the return was prepared determine what the discrepancy means. Later corrections can also help explain the reporting history.

Contracts, Payments, and Tax Returns

A deposit may represent revenue, loan proceeds, a capital contribution, or an internal transfer. Its classification depends on the transaction and applicable tax rules.

Contracts, invoices, bank statements, and ledgers can establish whether the reported amount reflects the underlying transaction.

A customer advance may raise a timing issue rather than concealment. Contract terms and accounting methods affect when income must be recognized.

Similar issues arise in tax audits and adjustments, where a proposed adjustment alone does not prove fraud.

Communications and Evidence of Intent

Emails, draft returns, and accounting instructions may reveal what the taxpayer knew before filing.

An instruction to omit sales suggests a different purpose from a request for advice about an uncertain deduction. Revision histories may identify who supplied figures and approved changes.

Professional advice matters when the taxpayer disclosed relevant facts and genuinely relied on that advice.

Original records should be preserved. Altering or deleting evidence during an investigation may create separate legal problems.

3. Civil Fraud and Criminal Tax Charges Are Different Claims

A false tax-related statement may lead to an assessment, civil penalty, private fraud claim, or criminal prosecution. Each proceeding has distinct legal requirements. A business dispute over tax-related representations must therefore be distinguished from an alleged tax offense.

Tax-Related Misrepresentation Versus Contract Breach

Incorrect tax information or an unfulfilled contractual promise does not, by itself, establish fraud.

Under California law, intentional misrepresentation generally requires a material false statement, knowledge of falsity, intent to induce reliance, justifiable reliance, and resulting damage.

A promise made without an intention to perform may support promissory fraud. Later nonperformance alone does not establish the speaker's original intent.

These private civil fraud elements do not govern federal criminal tax evasion.

Civil Tax Penalties and Criminal Liability

Under 26 U.S.C. § 6663, the IRS may impose a penalty of 75% of the portion of an underpayment attributable to fraud.

The IRS generally must prove civil tax fraud by clear and convincing evidence. Criminal convictions require proof beyond a reasonable doubt.

Private fraud claims follow their own liability and damages rules. A criminal tax defense review instead examines the charged offense and whether prosecutors can prove its elements.

4. Federal and California Tax Fraud Procedures

A tax fraud case may involve a criminal investigation, a disputed assessment, or both. The notice or charging document helps identify the applicable procedure, while relevant laws and procedural rules govern filing deadlines. These distinctions matter when reviewing evidence and potential defenses.

IRS Investigations and Federal Court Deadlines

An IRS civil audit does not automatically become a criminal investigation. IRS Criminal Investigation examines suspected federal tax crimes, while federal prosecutors decide whether to bring charges.

Under Northern District of California Criminal Local Rule 18-1(c), criminal cases involving alleged offenses in Santa Clara County are ordinarily assigned to the San Jose courthouse unless otherwise ordered.

For a statutory notice of deficiency, 26 U.S.C. § 6213(a) generally allows 90 days after mailing to petition the U.S. Tax Court, or 150 days if the notice is addressed to a person outside the United States.

These civil deficiency deadlines differ from criminal limitations periods. Under § 6531, the general period is three years, but specified tax offenses, including §§ 7201 and 7206(1), generally carry a six-year limitations period.

California Tax Agencies and Protest Deadlines

The Franchise Tax Board administers California income and franchise taxes. The California Department of Tax and Fee Administration handles sales and use taxes and other designated programs.

California Revenue and Taxation Code § 19706 criminalizes specified willful failures to file or supply information, and false or fraudulent returns or statements, when committed with intent to evade income or franchise tax.

Section 7153.5 applies when a person violates the sales and use tax law with intent to defeat or evade reporting, assessment, or payment and the unreported tax liability reaches at least $25,000 in a consecutive 12-month period.

For an FTB Notice of Proposed Assessment, § 19041 generally allows 60 days from the notice date to protest. An FTB Notice of Action following a protest generally carries a separate 30-day appeal period to the Office of Tax Appeals, measured from its mailing date, subject to applicable exceptions.

Other notices may follow different rules, so a state tax dispute should be reviewed under the applicable statute, agency procedure, filing deadline, and underlying records.
