Part 23 and Part 25 are not two versions of the same rulebook.Since the 2017 rewrite, Part 23 no longer prescribes how an aircraft must be built. It states the outcome and leaves the applicant to propose a means of compliance for FAA acceptance — which shifts the certification burden from meeting a specification to justifying an approach. Part 25 remains prescriptive. Which applies is fixed by the aircraft's weight, seating, and propulsion; it is not a choice. The choice is TC or STC. A new type certificate means establishing a certification basis from the ground up. A supplemental type certificate modifies a design already certificated, and it is faster — until the modification is substantial enough that the FAA treats it as a new type. Where that line falls is a judgment made early and expensive to revisit. Certification basis fixes your exposure. Which amendment level applies determines what you must show, and it is set at application rather than at approval. Programs that slip across rulemaking cycles find the ground has moved. After approval, the obligations continue. A production certificate carries quality system requirements that are audited, not assumed. Airworthiness directives are mandatory and carry compliance deadlines; an aircraft out of compliance is not airworthy, whatever its certificate says. And for manufacturers who export, EASA and other authorities validate rather than simply accept — a parallel process that runs on its own terms.
